CHICAGO Aug iThis morning Judge Baker issued a writ of kabcas corpus for the release of Martin Burke the Cronin suspect The writ was obtained by Lawyer Kennedy who has been refused permission to see his client returnable at 3 oclock this afternoon but was issued with the understanding un-derstanding that if the officials permitted Kennedy to see Burke before that hourthe matter would be dropped The chief of police allowed a friend of Dr Cronin t look at Burke this morning presumably for identification Chief of Police Hubbard in company with several of Dr Cronins friends went down t see Burke this afternoon for the purpose of identification by friends Hub bard carried him a letter which had been in the North side postoflice some time for Burke I was from his mother in Iowa The prisoner opened the letter and perused it When he had finished it he threw himself him-self on the floor of his cell and cried like a child Seeing his griefstricken condition it was decided to postpone the confrontation confronta-tion of the witness until another time An afternoon paper says that Chief Mc Crea of the Winnepcg police will be a witness wit-ness at the trial that he won Burkes con idence during the lattrs sojourn in Winnepeg and that the prisoner made important im-portant admissions to him The authorities author-ities hero are confident that Burke will eventual confess States Attorney Long necker said I do not think ho can hold out against the unavoidable prospect of execution for murder 1 think he will confess I am certain that Burke is one of the men who actually killed Cronin and nothing in the world can save him from the word gallows except ex-cept a juror who would not hang anybody with all the evidence we pave against Burke There is far more than has been published and there is no escape for him and he will drag down the others with him also We have evidence that cannot be controverted I seems that the murder of Cronin is not the first crime of that nature with which Burke has been Charged Ho was arrested in 1SS7 on suspicion of bay leg been connected with the death of one Tony Gallagher but was discharged for lack of proof At 3 p m the hour upon which the writ in Burkes habeas corpus was made returnable return-able Chief Hubbard States Attorney Longnecker and Corporation Counsel Hutchison appeared before Judge Baker The latter without any preliminary made an unexpected declaration in reply to the writ that Burke was not in the custody of Chief Hubbard at all Burke continued Hutchinson was in the hands of Officer Collins who had him on a requisition and who was acting as messenger for the President Presi-dent of the United States A whispered consultation her took place between Senator Kennedy and Lawyer Forest attorney for Coughlin who was present in the court room Kennedy then demurred to the return on the ground that it was evasive When applied to yesterday Hubbard had said Burke was in his cus tody and that the prisoner would be kept secluded A wrangle between the lawyers in the court ensued which was finally cut short by Judge Baker saying There is no aoubt that Burke is entitled to see his attorney and that Kennedy has a right to talk with his client As for the custody of the prisoner there can be no doubt that it lies in the hands of the person holding the writ of extradition Burkes lawyer then drew up a new peti tion asking that a writ of habeas corpus be directed to Officer Collins on the ground that that officer was bound under his commission com-mission as messenger to bring Burke into Illinois and to turn him over to the proper authorities This ho had not done but placed him in the police station of the city of Chicago under the jurisdiction of Chief Hubbard The petition charges that Hubbard was heard to say that he would not send Burke to jail before noon of August 12 as he had a purpose of his own in keeping him out Judge Baker then issued an order for the writ as prayed for I is returnable at hically > than any of the others charged for the same crime This morning he received re-ceived an express package from California and subsequently shook a roll of money as he expresses it in the face papers in connection with the seizure of the Black Diamond as far as received were forwarded for-warded to the governorgeneral at Quebec The deputy minister fisheries looks upon the recent seizure as one of great moment and will result in preventing the great seal fisheries in Behring sea from becoming entirely irely neglected The whole world he says has an interest in their preservation and the
