evidence adduced at the trial of President William Budge in the District Court at Blackfoot whose acquittal was chronicled in THE HERALD on Sunday morning last The United States vs William Budge unlawful cohabitation Henry Sagers duly sworn for the plaintiff testifies as follows QAre you acquainted with the defendant de-fendant AYes sir QHow long have you known him AI have known him about eighteen years QWhere have you known him AIn A-In Bear Luke QWhat part of Bear Lake AAt Paris Q Have yon at any time during these eighteen years lived at Paris A No sir QOr in that vicinity AYes sir at a place called Liberty QHow far is that from Paris AIt is about six miles Q How long has it been since you lived in the town of Liberty or in that county AIt has been between thirteen and fourteen years QAre you acquainted with his families A Nosir QDid you know at the time you lived there and at the time you left there in regard to the number of wives he had or that he claimed as such Objected to as being too remote Aao sir Idont know QDid you know any ladies that went by hs name AI know one woman that he had there his first wife I suppose QWhat was her name if you know 7 A I am not positive I believe it was Julia QDid he have any children at the time AYes sir QHow many did he have AI dont know how many hedid have two or three QDo you know the names of those children A I dont know but two QWhat were their names A Arthur Ar-thur and Julia QDid he have any other ladies there at the time or ladies who were known by his name ANot that I know of It QHave you been there at Liberty and Paris during the last ten or twelve yeers AYes sir QAnd have seen the defendant frequently AHave seen defendant at his house saw a lady there dont know her name she told me she was Mrs Budge she lived in the house under tne hill it is where William Budge lived while I w as at Liberty did not notice any children have had special appointment Deputy United States arshal the last few years have been appointed for Bear Lake made one attempt to arrest defendant a year ago last July saw him at the time did not arrest him defendant was going from the postoffice to his house I was In a house upon the hill and when I got to defendants house I could not find him he got in the house before I k lew who he was I went to the house and asked the lady it she was Mrs Budge and she said yes asked her where defendant was and she said he was not in did not search and he I and did not find defendant staid in the house fifteen or twenty minutes was in Paris two days on that occasion while there did not see any other ladies defendant claimed as wives W H Dye sworn says I reside at at Paris know the defendant know where he lives knew more or lest of Budges women and some of the children chil-dren dont know thejaajneaof the two ladies saw defendant and these two ladies first in Salt Lake City that was when I was a small boy lie brought them to my fathers office several times and introdnccd them it was twenty five or thirty years ago introduced in-troduced and acknowledged them as wives at the time saw two ladies at Paris whom I took to be the same ones I saw in Salt Lake believe they both lived in the same house i it was defendants defend-ants house am somewhat acquainted with several of Budges children dont know Julia Budge Arthur Budges name seems farniliar did not renew my acquaintance with the two ladies while at Paris saw defendant walking round the second wifes house with two children chil-dren saw him there several times never saw him in the house i both ladies were known as Mrs Badge it was common repute in that country that defendant had three wives i dont know who supported them Henry Boulton sworn save Reside at Pans have lived there for nine years am a shoemaker have been un lersheriff and sheriff there have known defendant for about eighteen years defendant has lived part of th time in Providence Utah and part in Bear Lake know his family defendants defend-ants wifes name is Julia know the names of some of her children Julia is the name of the oldest Miss Annie is about 18 or 19 years old Jessie is about 9 years old am not personally acquainted ac-quainted with any other lady by the name of Budge know of two houses of defendant Mrs Julia Budge lives in one house dont know who lives in the other dont know whether defendant spends part of his time there dont know the lady and children who live in the second house have heard the name of Belle Budge have seen her dont know where she lives dont know Lizzie Budge have heard her spoken of dont know what relation she bears to defendant know Julia Budge never met any other ladies by the name of Badge at defendants house except the young ladies know a girl whose name was Rosa Budge she is about 20 years old and suppose she is a child of de fondants she has resided with her husband mostly during the last five years she was married about three years ago have seen Lizzie Budge a great many times in Paris lave seen her on the same street def de-f nd > nts house was on have seen her go ow rds the house suppose defendant defend-ant is the father of Arthur Budge Mrs Lizzie Budge id his mother dont know who cares Jor her it was reported in that community that Budge had more wives than one I dont know myself C J Bassett sworn and testifies Was deputy marshal forthis district in 1885 had a warrantfor defendants arrest ar-rest attempted to arrest him went twice to Pocatello after him went once to Salt Lake never went to Paris did not find nor see him Mr Dubois and myself went to Bear Lake County once went to Montpelier and heard there that defendant had gone to EVanston know defendant avoided arrest the warrant was for unlawful cohabitation W L Hopson sworn and says Ama Am-a deputy marshal know the defendant have had him in my custody had some conversation with him it was coming from Ogden to Blackfoot he said he had raised children by his families and would not deny it and thought that no man would do so think that is his exact ex-act language Court instructs to find verdict of not guilty and the jury so finds |
