Show The Sharon Case Settled WASHINGTON May 13The supreme court today affirmed the judgment of the United States circuit court of the northern district of California in the case of David S Terry ct alappellant3 vs FW Sharon executor etc This is the suit brought by Sarah A HiltTerry The court holds that in the original case the citizenship of the parties being in different states and the object of the suit being the cancellation of a decree suits for cancellation being one of the oldest heads of equity jurisdiction The case presented was one of prima facie jurisdiction and if there were any errors in the origiual decision decis-ion they must be presented on appeal from the decree in that case and cannot be considered con-sidered in this case which is an appeal from a decision reviewing the action in the name of the executor of the deceased Sharon and that the objections urged to that decree of receiver are frivolous Opinion by Justice Miller |
