Show MISSED FIRE Mr Dickson Meets with a Defeat featI JOSEPH MOTJLTON DISCHARGED A SelfCoufesed Spotter Does Som Ardnous Work but All Without With-out Avail Mr Commissioner McKays Courtroom Court-room was yesterday the scene of a little deviation from the programme usually followed out in those surroundings Joseph Moulton the man who had been arrested in Heber City and whose examination ex-amination had gone over owing to the fact that the deputy had failed to subpoena sub-poena any witnesses except the firs wife came up to hear the complaint against him The lapse of twentyfour hours had failed to produce pro-duce any of the much desired witnesses and 3Ir Dickson was forced to put his informer and spotter upon the stand or to be content to see his prey slip from his clutches So with some apparent misgivings Mr Caleb Moore a stoopshouldered young man of rather a hunted and halting mien was called to the stand He testified with great ingenuousness that he had obtained a knowledge of his Moultons family affairs when the latter had trusted him under the supposition that he was a Mormon and seemed otherwise other-wise to be of the calibre to constitute him an efficient member of that delectable delect-able force with which Mr Dickson I operates He said he knew the defendant for about eighteen months and had worked at threshing for him about a year ago He with two others had eaten at Moultons had been introduced to Mrs Moulton as his first wife saw several children about the house who called the lady mother and the defendant de-fendant father On a subsequent vi it he said he had been introduced to I tari i beNlan f Mary Elizabeth and Annie Moulton as the defendants first and second wives He had assisted in serving the warrant of arrest and while so engaged Mr Moulton said Yon know I have three wives and I intend to live with them and live my religion Mr Dickson was satisfied and so expressed I ex-pressed himself when Mr Richards took hold of the ready witness and plied him with several questions among which was the inquiry Where did this conversation occur To which Moore replied In front obis house There was no one else present He reiterated re-iterated his statement that Moulton told Jiim he had three wives and would live his religion He informed the accused that Mr Shields would serve the warrant war-rant if he Moulton would step aside for a minute In answer to Mr McKay he said he roinembcred the date when he went to thresh for Mr Moulton by a bill for work which he had made out Mrs Ann Moulton followed in the witness chair Mr Richards objected to her being sworn but Mr Dickson insisted in-sisted on swearing her where upon the Commissioner ordered her to stand up and take the oath To the query Are you the legal wife of defendant she promptly replied Yes sir1 Mr Richards moved that the defendant defend-ant be discharged as nothing had been shown to warrant his being held on the charge in the complaint < The Prosecuting Attorney claimed to the contrary Mr Richards iisitcd that the prose culion had no right to presume guilt and then call to explain away any such vlaiiueiiconvictiou Mr McKay san that there was a new feature in the case which he could not decide upon without consulting authorities au-thorities and he thereupon adjourned his court until oclock in order to give him tme to read up At the hour namedtbe Commissioner summed up the evidence and concluded I that Moore did not testify that Ann and t Lizzie Moulton were the two mentioned I in the complaint the evidence was composed com-posed of uncontradicted admissions if the marriages were shown unlawful cohabitation could be established The identity of the women had not been clearly proven by the evidence There forethe accused and his bondsmen were discharged I I |
