Show It I T THE MOEGrAN MATTER The Recent Proceedings at Wan ship over the Case The parties mentioned as having seized the Grizzly tunnel on the Morgan Group of mines and were arrested therefor were tried before Judge Anderson An-derson at Wanship The charge of forcibly entering ana retaining the said tunnel was established and the prisoners prison-ers were adjudged guilty and a fine of 25 each with proportionate share of co ts of prosecution were imposed upon John B Parry A J Moore G J Barry and George Moulding The other four were released In a second trial on a charge of breaking break-ing into and holding possession of the cabin of Mr Schaer on the same claim the judge ruled that the case was the same and dismissed it In a third case before Judge Archibald Archi-bald at Snydervilie held oil Friday in which John B Parry and A J Moore are charged with breaking open the Mono tunnel in the same group of claims it was proven that Mr Meears and his representatives were in possession posses-sion of the group but the Judge decided de-cided to dismiss the case because the particular portion of the group of mines was not mentioned in a certain deed so that the matter was inadvert entlv made a trial of title rather than of misdemeanor It is but fair to say that the judges gave the cases their best attention and if they were a little puzzled at some points it is not to be wondered at considering con-sidering the parade and display made by the attorneys in the endeavor to present the facts which seemed to be innumerable The case proper has assumed a form wherein must soon i each final adjustment adjust-ment Whatever tho rights are will ot course appear Subsequent to the circumstance related re-lated the Morgan Mining Company or John A Groesbeck trustee has secured a restraining order from the Third District Dis-trict Court authorizing the Morgan Mining Company to do certain assessment assess-ment work in the Grizzly tunnel so that for the present both parties are represented Record I |
