Show JIVE rmOUSAD DQLLARS 3IfT Cuhninffliam Obtains a Verdict i for Onefifth ofrwhafHe Asked tASfStatedin the HEEALDon Thursday morning j the jury j in the Gunningham and Union Pacific case went out near 10 oclock on Wednesday night they remained closed mtheir room until about 2 oclock hursday mornings whenvhey arrived at a verdict sqaled it and separated The verdict was handed to Judge Zane at thesitting of court yesterday morning and read as follows followstlfe jury empaneled in the above case find for the plaintiff and assess his damages at the sum of 5000 t < CHAS GILL ORE Foreman A I iriotion for a new trial will be made by Williams 1S Young and if overruled an appeal will be taken Mr Williams states that the amount of damages is not unreasonable but that the theory of his side is that the Union Pacific were not to blame In the jury room u HKKVLD reporter re-porter learned there wad a wide diversity of opinion as to what I amount of damages ought to be I awarded Mr Cunningham On the first ballot the vote stood two in favor of finding 15000 damages one in favor of12000 one of 800 and others of various amounts ranging as low as 100 and 200 The final compromise on 5000 was effected after four hours deliberation de-liberation not our informant stated that the jury thought the amount an equivalent for Mr Cunninghams injury in-jury but that it was generally thought he was aware or ought to have been of the danger he was undergoing at the time the accident occurred |
