Show LEGISLATIVE ASSEMBLY i FIFTY EIGIIT DAY COUNCIL TUESDAY 10 am After roll call and prayer the committee on elections reported back the petition of Sidney Hudson and others asking that the voters in the elective districts or wards I of Salt Lake City be required to vote for aldermen and councilors in the several districts independent of the votes of the other districts or wards The committee found by the charter of Salt Lake City that the mayor and city council are authorized to take any such steps in the premises they may deem ue scary and proper and considered I it unnecessary to legislate farther upon the subjects Report adopted The committee on agriculture reported I re-ported on H F 30 to protect resident resi-dent stockmen and ranchmen and II provide for recording marks and brands also H F 00 in relation to barbed and other wire fences and II recommended that they be rejected Renorfc adoned The committee on revenue reported re-ported on H F 53 in relation to cancelling warrants without amendments and recommended its passage The committee on agriculture reported re-ported on H F 73 to encourage the manufacture of sugar with amendments amend-ments and recommended its pis sage The committee on judiciary r2 ported on C F 33 designating certain cer-tain holidays containing the Governors Gover-nors suggestions and recommended its passage The committee on education reported re-ported on C F 23 providing revenue reve-nue for district schools and recommended recom-mended a substitute bill licensing certain vocations and professions in the several counties making it unlawful I un-lawful for persons firms or incorporations incor-porations doing business as merchants mer-chants peddlers hawkers drummers drum-mers telegraph companies express agents sewing machine agents agents for the sale of agricultural implements agents for the sale of musical instruments surgeons dentists den-tists or physicians to do business without paying a prescribed license to the county collectors three fourths of which shall be paid into the school fund of the county The committee on railroads reported re-ported back H F 25 amending sections sec-tions 480 and 489 with amendments H F 71 extending the right of suffrage was read as reported from i the House with the amendment of the Council committee that every woman born in the United States or naturalized of the age of 21 or who is the wile or daughter of any born or naturalized citizen and 21 years of age shall be entitled to vote A motion was carried to make this amendment a separate bill Referred Re-ferred back to the committee H F 32 providing for fees of jurors in civil cases was read Councilor E Snow moved to refer the bill to the committee on judiciary from the fact that the bill fails to cover the whole ground brought to view in our judicial business and is defective in removing remov-ing the evils we are suffering Litigants Liti-gants in civil c ises should pay their own expenses and the expenses of the jurors Before the passage of the Poland bill the practice was to require litigants to pay all expenses in civil cases and the counties to pay the expenses in criminal cases but since then the practice has been to leave jurors at the mercy of litigants liti-gants and for the territory to pay criminJ expenses and the mileage grand and petit jurors and witnesses in both civil and criminal cases The law requires 200 names to be drawn each year and if the panel is exhausted to draw other names the Dumber of jurors so drawn would not fall short of 1000 each year and the territory is paying the mileage of all these persons so drawn the Councilor read some certificates of witnesses and jurors in the second judicial district from which was deduced the fact that i the charges for mileage were about threefourths of the expenses of our jury system He wished the bill referred to the committee to see if any system could be adopted to make the civil business bear its proportion of the mileage as well as the per diem The bill was referred H F 77 a bill to enforce the civil rights of the territory was read and passed H F 75 a till concerning the duties of county elerks was read and passed Councilor E Snow suggested that the reports of the county clerks be handed in during the first week of the session of the Legislature so that they might be understood and used by the members Carried Councilor Thurber moved that the reports be sent to the Council as well as the House of Representatives Representa-tives Carried Councilor Barton moved that the clerks be required to inuke their reports term of the ports during the June e county court Carried H F 81 to amend section 181 of the Compiled Laws of Utah was read and passed H F 05 for punishing cruelty to animals was read and referred lo the committee on judiciary H F 63 forbidding county and territorial treasurers and collectors to discount warrants and providing for the cancellation of warrants was read and passed H F 73 to encourage the manufacture manu-facture of sugar was read as amended by the committee Councilor Coun-cilor Wells moved to further amend by making it compulsory for the 7000 pounds of merchantable brown sugar for which 35000 premium is offered shall be produced in the territory ter-ritory in the year in which the award is given carried The bill passed its third reading Recess till 2 pm 2 pm Councilor Caine presented six re monstrances from 194 citizens of Park City and vicinity against the passage of any bill to incorporate Park City believing that the burden bur-den of taxes would be much more weighty than any good that could accrue also believing that the provision pro-vision in relation to elections was strange to the territory that any such incorporation is totally unnecessary un-necessary that the life of mining camps or towns is uncertain in duration du-ration A majority of the businessmen business-men are not in want of an incorporation incor-poration The patentee of the town site is the prime mover in this charter char-ter matter Referred to the committee com-mittee on municipal corporations Councilor Caine presented the accounts of Sergeantatarms John VanCott with vouchers Referred to the committee on claims and appropriations ap-propriations The committee on judiciary reported re-ported back H P 48 to provide for a revision of the laws of Utah with amendments The same committee reported back H F 71 extending the right of suf frage By unanimous consent Councilor Caine presented a bill to amend section 43chapter 2 titles This bill transposes the words of the present section conferring upon women the elective franchise so that it sha1 I read That every woman born or1 naturalized in the United States or who is the wife widow or the daughter of a native born or naturalized natur-alized citizen of the United States i of the age of 21 years who has resided re-sided in this territory six months next preceding any general or special spe-cial election shall be entitled to vote nt any election in this Territory Terri-tory This measure is introduced to place beyond quibble the construction con-struction of the law conferring upon women the elective franchise and Councilor Caine said he hoped the Governor would sign it so that there would hereafter be no room for doubt in any persons mind on the true meaning of toe law A message was received from the House stating that the Governor had approved H F 2 57 58 24 and 61 that he had disapproved H F 18 and had suggested amendments to H F 00 also asking a conference committee on H F 8 and 45 The Chair appointed Councilors Wells and Barton on H F 8 and Councilors Came and Murdock on H F 45 Another m ssage was received stating that the House asked for a conference committea on the fish and game bill acid that H F 10 the school bill had been passed Councilors Smoot and Thurber were appointed a committee of conference con-ference on the firsh and game bill C F 33 the bill designating legal holidays was read and passed H F 25 amending sections 4SO and 489 of the railroad act was read and passed H F 48 for the appointing of a committee on the revision of the laws of Utah was read and passed II F 71 extending the right of suffrage and Giving the females the right to bold office was read and passed C F 35 a bill amending section 43 chapter 2 title 3 of the election laws was read and passed H F 10 for amending the school bill was read and referred A message was received from the House stating that one of the Council Coun-cil amendments to the sugar bill was not concurred in The Council receded from its position on the objectionable ob-jectionable amendment By unanimous vote Councilor Cluff introduced a petition from E P Ferry and seventyfour businessmen business-men and merchants of Park City I expressing a desire that Park City I be incorporated and asking speedy and favorable action on the bill now before the legislature Referred to the committee on municipal corporations corpo-rations and town sites By unanimous vote Councilor Smoot presented a claim of Z Snow stating that he had been attorney general until the passage of the Poland Po-land bill and since then he has been constantly called upon by territorial i rofficers for counsel in territorial matters and asked for compensation compensa-tion therefor Judge Snow stated r that the last legislative body voted I him 6500 for such services as he had I rendered the two years previous Referred to the committee on claims Adjourned until 2 p m Wednesday Wednes-day HOUSE A communication from the Council Coun-cil announced that that body had passed the House bill to amend warrants without amendment also that it had passed the House bill to encourage the manufacture of sugar with amendments The amendments amend-ments were read and with one exception ex-ception were concurred in also that it has passed the House bill concerning con-cerning the duty of county clerks with amendments The amendments amend-ments were read and concurred in also that it lied passed the House bill to amend section 181 of the Compiled Laws without Mr Snow from the committee on elections reported on the petition I of Wm Lynch and 168 others asking ask-ing for amendments to the charter nof Salt Lake City recommending that the petition be referred of a substitute embracing the features of the three bills Mr Booth from the committee on judiciary reported on the joint reso lution relating to the collection of delinquent territorial taxes and recommended its rejection The resolution was rejected Also re portng favorably with amend ments the Council bill to tax dogs Mr Booth from the committee on municipal corporations and towns reported adversely on the petition of J W Crosby for reasons specified and recommended the passage of the House bill incorporating incorpo-rating Kanab City Mr Preston from te committee on appropriations reported back House bills 83 and 84 appropriating certain moneys and recommending their passage Mr Page from the committee on public health reported back a Council bill in eaiion to auaran tine without amendment and recommended re-commended its passage Mr Farr from the committee on judiciary reported back the House bill establishing and protecting them the-m rights of married women I with amendments and recommended J its i passage Mr Penrose from the committee on claims and public accounts reported re-ported recommending that 875 be appropriated to Joel Ricks SlSs32 to G M Brown and 25525 to Jas Jack The recommendations were adopted also reported on the financial finan-cial report of Rich County as correct cor-rect and it was ordered printed with other reports Mr Farr from the committee on judician reported on the House bill relating to costs in criminal cases without amendment and recommended re-commended its passage Mr Sharp asked permission to in troduce abill prescribing fees for the secretary of the territory in cer tain cases and for other purposes The bill was read the first and second sec-ond times by its title and referred to the judiciary committee Mr Francis moved thatSOO copies of the financial reports of the c unties un-ties be printed in pamphlet form and furnished for the use of mem bers and that said reports be printed and placed in the proper place in the journal The motion was made a concurrent resolution and so adopted Mr Francis moved that the committee com-mittee on appropriation be instructed I in-structed to inquire into the propriety propri-ety of appropriating Sl000 for cer tain purposes in Morgan County Referred Mr Partridge introduced a joint resolution providing that there shall be elected a special commissioner commis-sioner whose duty it shall l be to collect all information possible relative re-lative to irrigation wherever it may be found and such as may be of interest in this territory and that 1000 is appropriated fur the salary and use of such commissioner commis-sioner Mr Snow moved that the committee com-mittee on appropriations be instructed in-structed to place 8150 on the appropriation appro-priation bill as additional remuneration remuner-ation for the services of H G Boyle as chaplain The motion was laid on the table A number of bills were run through on their second eading by their titles House bill Xo 1 granting certain privileges to incorpoiated cities was taken up The Council amendment to section 4 was concurred in Mr Penrose from the special committee appointed to draft resolutions reso-lutions of respect to the late Orson Pratt submitted a report which was unanimously adopted The House substitute to the Council Coun-cil bill defining how appropriations shall be paid was taken up and passed To substitute bill for House bills 64 8G and 88 to amend section 2 chapter 21 was taken up on its third reading It provides that where the amount due as taxes is over S5 an additional remittance may be made to an amount not exceeding ex-ceeding onehalf of the amount so due The substitute which makes other amendments was adopted and Mr Preston moved that the tax may be remitted to the amount of 10 only and the motion carried The bill then passed The Council bill relating to the taxation of dogs was amended by the judiciary committee anJ was taken up on its third reading and the amendments of the committee were adopted The bill brought out some discussion discus-sion It provides that a county tax of 61 independent of the city tax might be assessed against a dog The bill was passed communication from the Council Coun-cil announced the passage of the Council bill designating legal holidays holi-days also the House bIll amending sections 4SS and 489 of the Compiled Laws with one amendment The amendment was concurred in also the House bill to provide for a revision re-vision of the laws of the territory with one amendment which was concurred in also the House bill extending the right of suffrage where there is a legal declaration of intentions to become ci izens with amendments the amendments were read and concurred in also that it had passed the Council bill to amend section 43 chapter 2 title 3 Compiled Laws also that the Council receded from its amendment amend-ment to the bill to provide for the encouragement of the manufacture of sugar
