Show Scovllle Expects to Prove Washington Following are the names mentioned in Scovilles affidavit as being material witnesses whose existence and names have recently re-cently come to the knowledge of counsel T Bragdon Marsha Green James Brooks Thomas Rathsbon Katie Collins George W McElfresh Manville A Austin and R McFarland The affiant is advised ad-vised and believes that he can prove that Bragdon Green Katie Collins and Austin frequently saw defendant in the park opposite the White House during the latter part of June A D 1881 and his Singular singu-lar and strange conduct slowing every indcation of insanity that those witnesses were thoroughly convinced he was of unsound mind and that the fact was freely commented com-mented on between them Affiant expects to prove by Brooks and Rathsbarn that they had an inter view with prisoner in the jail on the 3d of July 1881 or possibly the 2d in which the prisoner said I wish you people would let me alone I have some rights That it was some time before said Brooks and Rathsbon could induce him to talk to them and when he did talk he said to them at that interview that he had contemplated the removal re-moval of the President for six weeks and was forced to it by inspiration in-spiration from God or words to that effect and that he hai no fear of punishment and that he would bs liberated that the prisoner in conversation was apparently COOl and unconscious of any risk or danger dan-ger to himself from a trial for his act and showed bywords by-words and manner unmistakable unmistak-able evidences of insanity Affiant expects to prove by McEl fresh and Austin that they rode to jail with the prisoner as officers in charge of him immediately after the shooting and all the actions and words of the prisoner on that occasion occa-sion were indicative of an insane man Affiant expects to prove by Andrew MacFarlaud that he has been connected with an insane asylum and has had almost constant care and oversight of insane people for nearly thirtyseven years past being many years in charge of the Illinois state asylum for insane at Jacksonville in that state where he now resided and which position he now holds that he knew Guiteau in his lifo time and had an opportunity for a week during whicn time said Guiteau was his > guest at Jacksonville of scientific observations of the mental condition I of Luther W Guiteau in or about the year 1874 and came to the con I clusii n that he was insane on the subject of religion and still believes I so McFarlaud is of the opinion that the prisoner is now insane The affiant fart leI says he has been misled by the course of the prosecu cution giving the names of said McElfresh as a witness for the prosecution in this case and the in not calling him and that he would I otherwise have been called by the defense that he is not a detective I as also are said to be Brooks Raths I bon and Austin This affiant is informed in-formed and believes they are all in government employ and subject to I the call of the prosecution in this case at any time |
