Manufacturing Selling and Otherwise Disposing oft of-t JSpirluous Vinous and 4F Malt Liquors Be it ordained by the City Council of Salt Lake City That no person firm or corporation shall manufacture manufac-ture sell barter deal out or otherwise other-wise dispose of any spirituous vinous vin-ous malt or other intoxicating Kquorswithout first obtaining from the City Council of said city a license li-cense therefor as hereinafter provided pro-vided SECTION Applications for such license shall be made by petition to the City Council signed by the applicants ap-plicants and tiled with the recorder Said petition must state definitely the particular place at which the said liquors are to be manufactured old bartered dealt out or otherwise other-wise disposed of and whether at wholesale or retail The applicant shall also file with said petition a bond to Salt Lake City conditioned that during the continuance of his license he will keep an orderly and wellregulated house that he will not allow gambling with cards dice or any other device or impliments used in gambling within his house where such business is conducted I That he will pay all damages fines and forfeitures which may be adjudged i ad-judged against him under the provisions pro-visions of this ordinance and an act of the Governor and Legislative Assembly As-sembly of the Territory of Utah entitled en-titled An Act Licensing and Regulating the Manufacturing Manufac-turing and Sale of Intoxicating Intoxicat-ing Liquors approved March 9th 1882 Said bond shall be in the sum of One Thousand Dollars with two or more sureties to be approved ap-proved by the Mayor Said sureties sure-ties must justify on oath before the Recorder that they are residents within the territory and are worth the amount specifiedin said bond over and above all other debts and liabilities exclusive of property exempt ex-empt from execution Such justification justifi-cation shall be in writing signed by the persons justifying and certified to by said Recorder and be attached to and filed with the bond SEC 30Jl the City Council granting grant-ing the license petitioned for which shall be for a period of three monthsthe applicant shall pay into the City Treasury the amount hereinafter here-inafter specified for such license and shall receive the Treasurers receipt therefor and present the same to the Recorder who shall thereupon issue to the applicant a certificate of license which certificate shall state the name of the person or persons licensed the place of business the kind or kinds of liquors to be manufactured sold bartered or otherwise disposed I of the date of commencement and expiration of such license the class of business to be conducted under said license That the person or persons named therein are duly authorized au-thorized to carry on the business of manufacturing selling bartering or otherwise disposing of intoxicating liquors as the case may be at the place and for the time therein specified speci-fied and that the licensa is not transferable Said certificate shall be signed by the Recorder who shall seal the same with the seal of the city SEC 4A manufacturer as contemplated con-templated in this Ordinance is one who manufactures any of the be forenamed liquors and sells the same at wholesale as follows If in kegs not less than two gallons if in bottle not less than one dozen but no such liquor shall be sold or otherwise disposed of to be drunk on the premises where manufactured manu-factured A wholesale dealer as contemplated contem-plated in this ordinance is one who sells or otherwise disposes of such liquors in any quantity not to be drunk on the premises where sold A retail dealer as contemplated in this ordinance is one who sells or otherwise disposes of such liquois in any quantity and also by the glass or dram to be drunk on the premises where soK SEC 5The following named sums shall be paid into the city treasury in advance for each license granted as herein provided FirstAs a manufacturer one hundred dollars SecondAs a wholesale dealer two hundred and fifty dollars ThirdAs a retail dealer three hundred dollars SEC 0Any person licensed under un-der the provisions of this ordinance who shall knowingly give sell or otherwise dispose of any intoxicating intoxicat-ing drink to an Indian insane or idiotic person or to any minor without with-out the consent of his or her parents or guardian shall on conviction con-viction be fined in any sum less than one hundred dollars and shall pay all costs of prosecution for every such offense SEC 7Any person licensed as aforesaid or any person neglecting or reiusing to obtain a license as herein provided who shall sell give away or otherwise dpose of any intoxicating drink at any time during the first day of the week commonly called Sunday except he be a druggist and then only for medical purposes upon the prescription prescrip-tion of a regularly licensed physician physi-cian shall upon conviction thereof be fined in any sum not exceeding ninetynine dollars or be imprisoned impris-oned for a period not exceeding one hundred days or both such fine and mprisuiiuioi t SIC 8It iiall be unlawful for any dealer in spirituous vinous or malt liquors to permit at his place of business where such liquors are sold any gaming with or without betting by means of dominoes cards dice or other articles every game of chance and every other description of gaming or gambling He shall prohibit music dancing drunkenness and all disorderly conduct con-duct on his premises A violation of any of the provisions of this section sec-tion shall subject the offender to a fine in any sum not exceeding ninetynine dollars for each offense SEC 9The Mayor whenever in his judgment the peace good order or safety of the city or its inhabitants inhabi-tants shall require it and on Municipal Muni-cipal County and Territorial election elec-tion days and on all legal holidays may by proclamation forbid the sale barter dealing out or otherwise other-wise disposing of spirituous vinous malt or other intoxicating liquors for any given period not to exceed twentyfour hours at anyone any-one time and any person who shall sell barter or give away any such liquors in contravention of such proclamation shall on conviction be fined in any sum not exceeding ninety nine dollars for each offense SEC 10AIl ordinances and parts of ordinances relating to licensing and regulating the manufacturing selling or other disposition of spirituous spirit-uous vinous and malt liquors and other intoxicating drinks be and the same are hereby repealed Provided such repeal shall not effect any right accrued or liabilities incurred under the same but such rights and liabil ities may be maintained and enforced
