Show TELEGRAPHIC NKWS Important Decision Denver i2ln the United Stages Circuit Court this afternoon McCreary render d an important opinion in the contempt pr ceedings commenced by the plaintiff in the case of the Denver and New Orleans Or-leans Railway Company versus the Atchison Topeka and Santa Fe Railway Company The areumen was originally made before Judge I i Hallett who first entered an order I directing the defendant to account to the plaintiff fur the difference between the old division of through rates and the present proportion which is the same as the local through rate and which resulted from the competition between the plaintiff and the defendant The second required the defendant to restore the old anu higher proportion pro-portion which was formerly allowed by the defendant to the plaintiff The third required the defendant to check baggage through to the destination des-tination upon ticKets issued by the plaintiff Judge Mev reary upon argument reversed Judge Hal lett upon all the propositions except ex-cept the last He said In my opinion courts ought not to interfere for the purpose of preventing any reduction of rates which results re-sults from competition between rivals railway lines If as a result of a struggle for business between such ompeting companies they voluntarily offer to carry either for the public generally or for connecting connect-ing lines at less than rem l1neraton rates it is their own business Fiom the consequences resulting from a war of rates merely and from a struggle with rival companies to secure business the courts cannot relieve them |
