Show < CJITY COUNCIL 411 Proceedings of the City Council Tuesday evening April 171883 Mayor Jennings presiding George W Barr and Robert Edwards Ed-wards petitioned for the transfer of the unexpired portion of the license as retail liquor dealers issued in heir name to Messrs George W Barr and Arthur Smith who would continue the business at the same stand No 134 East Temple street Granted subject to the filing of anew a-new bond The Denver and Rio Grande Western Railway Company petitioned peti-tioned that the temporary track on second South and Fourth West streets be permitted to remain there at the pleasure of the Council like the other tracks already on Fourth West street as the company had assumed the Council would give them the same privilege in the street already accorded to another company They found a considerable consider-able amount of business since the opening of their through line that required an outlet in this way They would put the track in the middle of the street or anywhere desired by the authorities and would also put the street in order as done on Sixth West street Referred to the committee on streets and alleys Youngberg S chade petitioned for the privilege of occupying part of the street and sidewalk on the corner of Second South and Plum streets for a period of ninety days for the purpose of storing building material thereon Granted under the usual restrictions Applications for licenses to do business HS retail liquor dealers for ensuing three months from Peter Tourney G A Whitehead and for license to manufacture malt liquors from Keyser Moritz were presented for action and granted AMiner city attorney petitioned verbally in behalf of Col John Reese the proprietor of the small fruit and notion stand located across the ditch at the corner of East Temple and First South streets that he be allowed to continue said stand and business six months longer lon-ger A certificate signed by Cun nington Co who occupy the store immediately adjacent was intro duced The certificate stated the stand referrred to was kept and regulated in a cleanly orderly and neat manner was no obstruction to the streets and that they had no objection to Col Reese continuing the same The verbal petition was received and tne prayer thereof not granted as it was considered to be an injus tice to allow the stand of petitioner to remain when applications for the same privilege were refused by the city marshal almost daily ands and-s the streets were now measurably unobstructedit was deemed prudent t < j keep them so if possible The committee on irrigation to whom was referred the petition of Gee Goddard asking for a proper share of the water flowing into Salt Lake City recommended that the city watermaster be instructed to allow the petitioner the use of surplus sur-plus water with due regard to the rights of his neighbors The committee com-mittee also reported back the petition peti-tion of G D B Miller complaining of injustice done him in the distribution distri-bution of irrigating water and recommended re-commended that it be laid on the table indefinitely there being in the judgment of the committee no just cause for complaint Adopted The committee on irrigation to whom was referred the report of the watermaster for the quarter ending February 28th1888 reported that they had carefully checked the same compared with the vouchers I and found it correct and they recommended re-commended that it be approved and placed on file Adopted The committee on irrigation to whom was referred the petition of Joseph Toronto asking an appropriation appro-priation to cover damages done to property on account of the overflow of water from a public ditch in rear of his dwelling reported that the overflow alleged was caused by a sudden and unusual thaw and was a casualty which was due fo the elements over which the city had no control ana recommenaea tnat the prayer of the petitioner be not granted Adopted The committee on streets and alleys to whom was referred the petition pe-tition Walker Bros and ten others in relation to condition Second South street between First East and West Temple streets recommended that Second South street be brought to its proper grade between the points indicated in the petition and also that First South street be Improved in the same manner between the above named points and that the street supervisor be instructed to cause the work to be done as soon as practicable Adopted The special committee appointed to locate places where all warehouses ware-houses might be established within the city recommended that block 134 plot A be designated as one place an oil warehouse being already al-ready established there by the Continental Con-tinental Oil Company That by permission of Hon William Jennings Jen-nings who owns the premises the northeast corner lot of block 100 I plat A be designated as another place both locations being on the line of Utah Central Railway the II latter the one accepted by the Standard Oil Company for the I erection of its warehouse also j that by permission of Mr Henry Wood superintendent of the Denver Den-ver and RIO Grande Railway Company Com-pany two blocks lying on Fifth west street between Fourth and Sixth South or the block lying on Sixth West street between Second and Third South streets on the Denver and Rio Grande grounds be designated as a third place Tas committee further recommend that permission be granted to any and all persons establishing oil depots in any of the locutions mentioned to lay and operate side tracks in front of their respective premises on the streets as they may deem necessary The report was adopted and the comm1tte discharged The city attorney here introduced abill for an ordinance on the subject sub-ject of storing oils and other explosive explo-sive substances which he had prepared pre-pared in pursuance of instructions from the Council The bill was laid over to come up in its order The committee on waterworks to whom was referred for consideration considera-tion the draft of ao ordinance imposing im-posing a local tax for erecting and maintaining hydrants reported that they found the present income of the city from water rates to be about S13000 per annum That the total cost of the waterworks was about 3 60000 the amount received for rates being equivalent to an interest in-terest on the investment of 7J < percent per-cent per annum and the committee believed from present prospects that it would pay from S to 10 percent per-cent before next January if there were no further pipe extensions If tIle city continues to extend its water mains moderately that the income from the water supply would meet the expense and in a short time the whole city might be supplied with pipe water That up to the present onefifth of the entire cost of the waterworks had been received re-ceived back in water rates The committee therefore recommended that the bill for an ordinance be not considered Adopted The following report was submitted sub-mitted Your committee appointed by his honor the Mayor to consider tho petition of Edw W Tullidge oflering to write the history of Salt Lake City and asking an appropriation to partially remunerate him for the expense to be Incurred in the undertaking respectfully report that they have interviewed the petitioner and have ascertained that it is his intention to first publish the history in Tullidges Quarterly Magazine and afterwards if desired in a separate volume Your committee believe that now before be-fore the older settlers of our cify have passed away is the belt time to collect accurate materials to compose the history his-tory of this municipality and in view of the great necessity for a written history of a permanent character for reference we believe that the work should not be unnecessarily delayed Your committee therefore recommend in view of the recognized ability of Edw W Tullidga as an historian as evidenced by the endorsement of so many of the prominent citizens and taxpayer of the city that the gum of 1500 be appropriated appropri-ated to assist in defraying the expense of writing tha history of Salt Lke City upon the following conditions vizThat That Edward W Tullidge be required to give B bond to Salt LSKO City with good and sufficient security to be ap poved by the City Council that he will perform the work to the satisfaction of the City Council That the manuscript or copy before appearing in petitioners magazine shall be inspected by some competent persons to be selected by the Council That when these conditions are faithfully complied with the petitioner peti-tioner be allowed to draw on the city treasury for 8500 That when twothirds of the work is performed the second 500 be paid and that the balance 500 be paid upen the completion of the history his-tory Kespecifullv H BINWOODKT DANIELU WELLS Special Committee After a prolonged discussion the report was laid on the table subject to call The joint committee to whom was referred petitions of William C 2Ttil and others F Balwinkle and I others and Gideon Ryman and others reported that they had carefully care-fully investigated the matter referred re-ferred to in said petitions and in view of the additional cost to the city which would be incurred in granting the prayer of the petitioners petition-ers and of the fact that under the new irrigation ordinance the petitioners peti-tioners would he fully protected in their rights to water for all purposes pur-poses they recommended that the action of the Council on March 27 1883 be confirmed and that the prayer of the petitioners be not granted Alderman Raleigh introduced the following minority report which he I asked to be read and spread upon I the minutes j 1 Your joint committee to whom was referred the petition of Gideon Rymsn and others and the petition of W C Neil and others and the petition of Fred Balwinkel and others in relation to irrigation waters and the water way of petitioners in Plot E with instructions to allow a confarence with a committee of said petition era report that they have visited that locality with a committee of said petitioner and have given the matter of petitioners a careful investigation and we deem it to be the natural and reasonable reason-able right of any person or body of perSons per-Sons when water is to be removed from a waterway which they own a right ia to ask by petition or otber wisa that their lawful proportion and no other of said waters be taken in the straightest shortest and most feasible route to them appearing to be in their best interests and especially when the same ia confined to either side of a public street and that such reasonable request should be granted and we fail to see what natural or reasonable right any other person or body of persona have to I interfere to coerce or hinder them from the free exercise of such right by claiming I claim-ing that inch water should be taken on the opposite side of a street for their I convenience or for any other purpose to the injury as is claimed of the ovners of laid waters I Therefore we recommend that the city watamsiter be instructed to proceed with his work on Centre treet Plat E aa instructed by the City Council when adopting the report of a joint committee ou the subject J ecemborSOtb and when heih 11 have completed the work that he ba instructed in-structed to divide the waters entitled to run in what is called the old bathhouse ditch at the junction of the two street crches PD Centre street a liltla north of the residence of the late Mr Hopwood and put the proportion belonging to the petitioners Gideon Ryman and others and petitioners W 0 Neil and others into the ditch on the upper or east side of said street as asked for by said petitioners peti-tioners and put the portion of said waters belonging to petitioners Henry Grow and others for culinary irrigation and all purposes into the ditch on the
