Show MINERS PROVING ALIBIS. Procesdings In the Trials Before Federal Court at Moscow. Moscow. Ida., Nov. 2 In the trial of the Coeur d'Alene miners for interfering interfer-ing with the mails, the prosecution closed its case at noon yesterday. During Dur-ing the proceedings the defense made a motion to strike out of the case all the testimony by witnesses who had testified before the coroner's jury on the death of Smith and Cheyne, who were killed on April 29, the day of the alleged al-leged obstruction of t'? mails. The ground taken was . that the defense de-fense had been refused access to tha records of this proceeding, and therefore there-fore the defendants were deprived of the opportunity to use. evidence given prior to the present testimony for purposes pur-poses of impeachment; that if the records rec-ords were on hand they anticipated no trouble in showing that some of th I witnesses were false or mistaken in the statements made in the court. The do- : fense introduced ten witnesses who at- tempted to prove alibis for the prison- j ers. I 1 Today many witnesses were intro- j duced by the defense and the testi- 1 ninny was presented to show that all th? f prisoners except one was engaged in other business, and were not present ; when the mill was blown up: that they were not a part of the mob that de- ; layed the mail train. The defense will put three more wit- nesses on the stand tomorrow, and thid i will finish the evidence. ; ' |
