Show THE WEBB INQUEST the webb inquest closed aug 2 W L KINNEY the engineer testified I 1 was in charge of train 22 when mr webb was killed I 1 was called at pm the brakeman brownlee told me he wanted to do some switching so we went to work he gave me a signal to go ahead I 1 started and the train broke in two brownlee signaled me to stop and I 1 did so they were working for fifteen or twenty minutes I 1 could not get the right injector on the engine to work and was waa fixing that when the con ducthi came down and asked me if I 1 had water enough in the boiler to make a switch I 1 told him yes he told me to back up about a car waited till he got back and they gave me a signal and I 1 backed I 1 got a signal to stop and did so there were three lamps so f I 1 do not know who gave the signal I 1 then went to repairing the injector when the conductor oame running down and said there was a man killed under the car I 1 only backed up once I 1 did not know there was anybody under the car I 1 reversed my lever which might have moved the car a little and let the cars take up the slack the engine did not move it was waa after this that the man was reported killed I 1 supposed the men were through throng hafl fixing x the break when conductor nold wd asked me if I 1 could make a switch he did not say there was anyone between the cars there was a bolt gone from the injector I 1 only moved as conductor the ordered these thele is no signal to let us know when men are working under the cars can I 1 know nothing of the second backing I 1 only moved once in the six or seven cars care between the engine and the break these would be slack enough to cause the last car to move as far as the witnesses have said 15 inches on passenger cars when the air breaker are out of order the brakes tighten and the care can stop on freight train the reverse is the effect I 1 have seen the slack in cars taken up by a mere shaking of one car after the train is brought to a standstill I 1 did not use the air brake because it was not necessary I 1 have no idea how the man got killed I 1 know nothing of the broken 1 I have been an engineer since january last when I 1 parsed an examination I 1 3 was fireman before then for four years I 1 never had an accident before there was a carload of horses thereon and the moving of the animals might have started the slack JAS H TUCKER corroborated engineer kidneys kinneys Kin Kilan eVs statement as to the injector being out of order the engineer sent him to notify the foreman and when he came back the train had been moved he had just got on the engine when the accident was reported theory were not satisfied on the question as to whether or not there had been criminal negligence on the part of the company they retired for discussion and finally found as their verdict that the deceased died from the effects of being crushed between two cars care on train no 22 which were moved by some cause unknown to the jurors |
