Show HAYES WANTS SIE CBS JOB Colonel A B Hayes has announced his intention to contest the election of I H Spencer a a member of the constitutional convention from this county According to the jreturns a certified to the Utah commission by the several judges of election in this county coun-ty Mr Spencer na a majority of six votes over Mr Hayes Wen Interviewed by a Herald representative rep-resentative yesterday Colonel Hayes said he was not in a position to discuss the matter to any great extent at present pres-ent but that it might be set down as a fact that he would contest Mr Spen cers seat in the convention S He could not give the grounds of the contest at present but I is to be presumed pre-sumed that it wU be based on an allegation alle-gation that there is an error In the tally sheets It will be remembered that at first the total vote as figured by the commission com-mission gave Sir Hayes the election over Mr Spencer but on going over the returns again a clerical error was discovered which gave Mr Spencer a larger vote than Mr Hayes At the time there was no claim made by any member of the commission that there was any irregularity in the tally sheets save this error which was very clear and the Republican members readily assented to the correction being made The returns from this county a collected col-lected by The Herald did not Indicate the election of Mr Hayes and from the first the claim was made that the Democrats had elected six and possibly seven of the delegates I will be interesting to learn the exact grounds of the Hayes contest and there is little doubt but that Mr Spencer will retain his seat until the close of the convention at least when he may be willing to resign 1 to Mr Hayes without the formality of contest I proceedings i FOURTH twenty days to answer gven CITY COUNCIL The city council met in special session ses-sion yesterday morning to hear protests pro-tests against the opening of Hudson avenue President Spencer occupied the chair and all members were present pres-ent except Gibson and Pincock A number of protestors occupied seats in he council chamber Protests were read from W H Stevens Stev-ens D H Peery sr H Morley Among the protestors are those who do not own property abutting on the street but whose proposed new property prop-erty is In the rear and the construction construc-tion put upon the law by B 1 Allison Alli-son jr who appeared for a nub l of the protestors was that they had aright I a-right to protest The objections arc principally urged on the ground of I taxation that the street will be of no material benefit that it will depreciate in value property adjacent and that those who propery wI benefitted should purchase the property and present i to the citywho S Those who petition in favor of the improvement represent 72150 square feet and those who protest against its ow 59840 square feet making a total of 132000 or 12300 in favor of the proposed pro-posed improvement After some discussion of the matter by several of the protestors the council adjourned The matter will be brought up at a regular meeting in the near future THE C1TT COUCI The city council met In special session ses-sion this evening to consider the proposition propo-sition of reducing the number of streetlights street-lights from 7 to 12 James Moffat representing the Salt Lake Ogden Gas and Electric Light company was present and was asked to give his views in the mutter He said as lie had been Invited to attend the meeting he would prefer to hear what the members of the council bad A resolution decid to say resoluton was passed ins to reduce the lights to 12 and If then transpired for the first time that a contract had been entered into between a tween tlie electric light company and the city of Ogden by which the former was to furnish to the city anywhere from 75 to 150 lamps at the rate O 1350 to i15 per arc light according to the number of lights used but the minimum was fixed at 75 This contract con-tract does not expire until November 3 1895 and Mr HofCatt said his company com-pany was prepared to carry out its part of the contract and he expected the city would do likewise A question was raised as to the candle can-dle power of the lamps being furnished and Mr Moffatt suggested that the city appoint an expert to test the lamps on behalf of the city The existence of the contract was a surprise to the council ahd the mater was referred to a committee to Investigate Investi-gate and determine if there was anyway any-way out of it and to ascertain the real status of the
