Show II I LESSEE AND LEASOR I The Curious Case of Egan vs Pod Jecli I In the District Court this morning the I case of E D Egan vs Augustus Podlech came up for trial before Judge Zane I Messrs Hall Marshall for plaintiff and j Arthur Brown for defendant This is a somewhat curious case inasmuch as the lessee is sued for an alleged failure to perform his part of a contract as leasor to the landlord The plaintiff is owner of the White House property which was leased to Mr Podlech in April 1882 Egan claims that a contract was entered into between him and Podlech under which the latter agreed to lease to the plaintiff the suite of rooms in the extreme northwestern part of the second floor of the White I House building during the five years of Podlechs lease of the premises at 10 per month That Podlech subsequently refused re-fused and still refuses to fulfill his part of the contract by giving possession of the said suite of rooms j wherefore Egan prays for a judgment for 1920 damages The defendant claims that by the terms of the abovementioned contract Egan was to have his choice of two suites of rooms viz The suite in the northwestern northwest-ern part of the second floor or the suite then occupied by Mr Podlech and his family and that Egan selected the latter suite and took possession thereof Defendant De-fendant denies that plaintiff has been damaged in any sum by his failure to obtain ob-tain the said northwesterly suite of rooms but alleges that the rental value of the rooms actually occupied by plaintiff is as great as that of the northwestern suite |
