Show THE HERALD SWINDLE A Fraudulent and Criminal Device De-vice ro The Last Desperate Resort of a Tottering Tower 1 The Salt Lake Herald being without principle and possessing no intrinsic merit of any kind to commend it to the public is driven to most desperate expedients ex-pedients to maintain any sort of circulation circula-tion So despicable a sheet might naturally nat-urally be expected to resort to any other than honest and straightforward means to keep itself from sinking but it would scarcely have been supposed that it would openly attempt to hoodwink and cheat the people by a device at once fraudulent and criminal To induce subscriptions for the worthless sheet it is sought to induce I in-duce the public to believe that what they do not get in the paper which is nothing they will get in a few worthless articles put into the chance of a lottery It is proper in this connection to refer to chapter chap-ter IX of the Penal Code of Utah and commend the subject to the consideration of the Grand Jury and District Attorney These sections of the law may be read with profit SEC 16S A lottery is any scheme for the disposal or distribution of property by chance among persons who have paid or promised to pay any valuable consideration consid-eration for the chance of obtaining such property or a portion of it or for any share or any interest in such property upon afly agreement understanding or expectation that it is to be distributed or disposed of by lot or chance whether called a lottery raffle or gift enterprise or by whatever name the same may be known SEC 169 Every person who contrives con-trives prepares sets up proposes or draws any lottery is guilty of a misdemeanor misde-meanor SEC 170 Even person who sells gives or in any manner whatever furnishes furn-ishes or transfers to or for any other person any ticket chance share or interest or any paper certificate or instrument I in-strument purporting or understood to be or to represent any ticket chance share or interest in or depending upon the event of any lottery is guilty of a misdemeanor mis-demeanor C SEC 171 Every person who aids or I assists either by printing writing advertising adver-tising publishing or otherwise in setting up managing or drawing any lottery or in selling or disposing of any ticket chance or share therein is guilty of a misdemeanor SEC 172 Every person who opens sets up or keeps by himself or by any other person any office or other place for the sale of or for registering the number of any ticket in any lottery or who by printing writing or otherwise advertises or publishes the setting up opening or using of any such office is guilty of a misdemeanor SEC 175 Every person who lets or permits to be used anv building or vessel I or any portion thereof knowing that it is to be used for setting up managing or drawing any lottery or for the purpose of I selling or disposing of lottery tickets is guilty of a misdemeanor It is to be presumed that the Herald j k ewif it can be supposed that it ever I knew anythingof these provisions of the law and that under them it would I not be permitted to distribute the so n called prizes This was but a part of the scheme of fraud Having obtained the money of the people this law would be their excuse for not parting with their property as promised That this part of I the fraud may not be entirely successful let the following section of the statute be put into operation SEC 174 All moneys and property offered for sale or distribution in violation of any of the provisions of this chapter are forfeited to the Territory and may be recovered by information filed or bv an action brought by the attorneygeneral or by any district or county attorney j in the name of the Territory upon the I filing of the information or complaint the clerk of the court or if the suit be in a justices court the justice must issue an attachment against the property mentioned men-tioned in the complaint or information which attachment has the same force and effect against such property and is issued in the same manner as attachments issued from the respective courts in civil cases |
