Tho examination of Josie Hill Sid I Larklns Lottie Miner and Dick Edwards the four persons charged with the murder of Edward Callihan was resumed in Commissioner Com-missioner Greenmans court Mr Eichnor prosecuted alone Mr Murphy being engaged en-gaged elsewhere and Messrs Glenn Gun ter Armstrong and Hamilton appeared for tho defendants Marshal Young was recalled and said he bad submitted the bullet found in Calli bans body to a gunsmith who pronounced it to be a 41cahbre On the morning of the 5th of Juno 1891 he was present when Officer Poolo informed Lottie Miner of the arrest of Josie Hill on a charge of being concerned in the killing of Callihan Miner asked Does Sid know referring to the defendant Larkins and said she would go up and see Josie I To Mr Armstrong witness said ho first learned of the murder from Officer Poole near the Franklin Avenuo theater about 3 oclock on the morning of the tragedy Witness called up the patrol wagon and went down with several others to where tho dead body of Callihan lay FRANK M GLENN stated that he visited the house of Lottie Miner on Franklin avenue on the night of June about 1115 At the door of the house he encountered Jcsie Hill who was entering just In advance of him The defendant de-fendant Kdwards was crossing tho street towards the house Witness asked Miner if she wished to see him as ho had received word to that effect She said Yes aud took him into her private room She tuen stated that Josie Hill and Cal Bean tne hack driver had taken Callihan to the springs that they were going to rob him even if they had to kill him and that she did not want anything of that kind to happen hap-pen from her house Attorney Glenn for tho defense objected object-ed Until a prima facie case of couap racy was made out the statements of none of tho codefendants was admissible Prosecuting Attorney Eichuor We can prove this conspiracy by circumstantial evidence altogether by parts and then connect it The CommissionerThis being a preliminary prelim-inary examination and it being out of the power of tnis court to impose any penalty I think the questions asked and the answers given would be competent in this case You may proceed Mr Eichnor Anything that will throw light on this matter will I think be competent Continuing Mr Glenn testified to Miss Miner telling him that she had a horse and buggy hired and ready for him aud Officer BIrkuer to follow those parties The boIse and buggya pianobox buggy were tied up in the avenue nearly opposite Miners house Miner said to him just before he left the house If they go out again I will send for I you even if I have to go out myself In my chemise to lind ouI Sue did not send for him however On tho night before the morning of the murder in a room at Miners house ho saw a men who afterwards after-wards turned out to be Callihan lying on the bed Mrs Minor handed witness a sum of money in all S593 which he said sho wanted him to count she wanted it counted in the pmsonca of wItnessesso that if the man to whom it belonged should afurwaras kick she would have those witnesses ready to stato the correct amount She told him after this that she had given the man his money back The defense objected to this Rort of testimony tes-timony on the ground that it was hearsay and after some discus ion tun witness testified tes-tified to Mr Armstrong that he was standing stand-ing at the corner of First South and Commercial Com-mercial streets about 330 in the morning when he received tho first Intimation otC ot-C murder Ho went down the State road with others and saw the dead body of Callihan which he then identified as that of the man whom he saw lying on the bed in Miners house the night previous previ-ous not long before midnight Officer Poole was with witness when tho money was counted Mrs Minor said it belonged Ito I-to a man in Dora Hansons room and that sIlt Miner had taken it from his pocket POLICE OFFICER W II POOLE testified that ho was called with Sergeant Glenn to go to Franklin avenue on the night of Juno 4th uy a man named Ben Brlscoe who said he had seen his daughter daugh-ter at Lottie Miners house and that he wanted them to get hsT out of there They went to the place but did not find the girl It was then that Lottie Minor asked witness wit-ness and his brother officer to go into her room and count the money spoken of by the last witness She went out of tho room and returned shortly aftewards with the 595 nearly all in 20 bills which Glenn counted This took place About midnight mid-night on the 4th Witness saw the man In Dora Hansons room Mrs Miner told thorn that she wanted them to count the money so that there should be no subsequent subse-quent trouble Ho learned of Callihans murder about 4 oclock the same morning Witness did not BO down to the spot where the dead body of Callahin lay on tho State road but remained at the City hall to take charge of Josie Hill who was then in custody cus-tody At this stage a recess was taken until 2 p mIn m-In the afternoon GEORGE HERDOX was called and he testified that he never had stated to a certain woman that he could put his hand on the man who killed Cullihan nor had he since stated that he was afraid to testify CARL J BIRKNKR testified I am a police officer of this city and about oclock on the morning of June 5 last Lottie Miner came to me on the White house corner and asked me to go to her house at once I told her that Officer Pool was on the avenue and she could see him I do not recollect going to her house m company with F M Glenn nor do I remember re-member haviat had any conversation with her about a buggy LON IIIXKLE v testified I reside in this city and saw Ed Callihan here last June At about 2 oclock on the morning of June 5 I saw Callihan drive away in a buggy from in frontof Lot tie Miners with a woman I had known Callihan for a year and a half SAM GKOltSUECK testified In June last I was running the national Baseball park at the corner of State and Roper streets On the morning of June 5 Ed Cnllihan and Josie Hill came to the place They went In tbe bar room and after taking a drink with them I went back to bed I did not bear any shots I Callihan was not right drunk and Josie Hill did not appear to be intoxicated ED E LIVINGSTON testified I was employed at Mr Groes I becks place in June last and recollect seeing I see-ing Callihan and Josie Hill there on the morning of June 5 Shortly after they left I heard two shots fired HOLLA COVET testified was working at Groesbecks at the time of the homicide and waited upon Calliban and Josie Hill when they came there Callihan took a couple of drinks and Josie took beer They were there only fifteen or twenty minutes DORA HANSON one of Lottie Miners star attractions testified tes-tified I have lived in this city four years and was at Miss Miners in June last Ed Callihan came to the house first on the night of Juno 4 and stayed with me He had a big roll of money and left my room I at noon tbe next day and later went to the springs with Josie i did not see Dick Edwards in the house that day I Did any one come there that day and ask for a gun 1 No 1 just heard the colored girl say something about Miss Lottie giving someone some-one a gun Has any ono talked to you about this case except Officer Glenn 1 No And you aro as sure of that as of anything any-thing
