Recognizing that Park City has passed that critical point. Diversified Subversive Newspapers has decided to step up the pace, so to speak. Earlier today. Park Record Publisher Andy Blowhard gathered his staff together to impart the exciting news beginning April 1 The Park Record will be published twice daily. "See, going twice-a-week wasn't so hard." Blowhard told Production Manager Anna Sleepwalker, who last fall was married on her lunch break so as not to disrupt deadlines for the "Let us be thankful for the GUEST EDITORIAL Deciding on Flagstaff by PAUL F. SINCOCK Park City Council Member The March 26 meeting of the planning commission brought closure to its role in a very lengthy annexation application for the "Flagstaff Area." The matter now moves on to the city council for our consideration con-sideration and judgment in the next few weeks. In order to provide the most useful public dialogue and thoughtful consideration considera-tion on this matter, may I suggest a few guidelines for anyone interested in assisting assist-ing in this process. The annexation process is a negotiation between an applicant (United Park City Mines, et al) and the people of Park City, represented by city staff, appointed and elected officials. Negotiation is a process which must take into account the issues, interests and positions of the parties. Often, in public processes, it is easy to fall into "positional bargaining." where the parties tend to stale their positions (for or against a proposal), but rarely examine the underlying interests which must be satisfied satis-fied for both parties if a durable 'agreement is to be reached. The most effective negotiation process is "interest-based negotiation." Instead of arguing over positions, which tends to cause mistrust and deadlock, asking the question "why?" focuses the discussion on the underlying interests of the parties. The planning staff and commissioners have identified a number of public interests which need to be satisfied. They have recommended rec-ommended certain constraints and conditions condi-tions on development in an attempt to satisfy sat-isfy those interests and the interests of the applicant. These assumptions, interests and recommendations will now be examined exam-ined by the city council, with the assistance of staff and additional public input. In order to be most helpful (to me at least). I would appreciate public input which examines the interests of both parlies par-lies and suggested options to meet those interests. For example, here is a partial list of issues which must be addressed: 1. Extent of development (density, location, loca-tion, access) 2. Extent of ski development (number of lifts, runs, cuts, etc.) 3. Transportation, traffic and access issues (permanent and construction-related) 4. Open space, wildlife habitat, trails, recreational uses, etc. 5. Affordable and employee housing (on-site and off-site) 6. Financial and economic impact issues for both parties 7. Infrastructure impacts (sewer, water, storm drains, streets, etc.) 8. How does the development impact the recreational uses (skiing, hiking, biking, bik-ing, etc.) which forms the basis of our resort-based economy and lifestyle? b. How does the development impact the experience and perception of visitors to our community? Part-time residents? Full-time residents? What image and experience expe-rience of our community do we want to present to the world? c. What are the consequences of not annexing? What is the extent of likely development under the county? What are the direct and indirect impacts to Park City of development under county authority? Next to each of the above issues, draw two columns on a sheet of paper. In the first column, list the underlying interests of Park City for each issue. In the other column col-umn list the underlying interests of the applicant. Once you have done this, develop devel-op your suggested options and recommendations recommen-dations which will best satisfy the interests of both parties, if possible. No. it's not easy. This is the process I will be using to analyze ana-lyze and consider the Flagstaff Annexation Application. I'm sure other coarfdlmtim" bers will be doing the1 same. Your considered consid-ered input and independent analysis, as outlined above, can be very helpful. We alreadv have access to a great deal of factual fac-tual information on this proposal. We have read the planning commission minutes and heard the public input at the Yarrow public pub-lic hearing we know your concerns and positions. What I don't know are the specific spe-cific options and recommendations you would offer to meet the interests and issues outlined above. We live in a state where "property rights" are very important. The Common Law. which forms the basis of our Constitutional form of governance, recognized recog-nized that every "right" carries with it an equal "responsibility." In the case of Flagstaff, the applicants are requesting the city grant additional development rights over and above existing county zoning. These development rights have economic value only because of the surrounding community. Thus, there is conveyed a responsibility upon the applicants to meet, to the extent possible, the interests and goals of that community. Similarly, the community has a responsibility in conveying convey-ing additional development rights, to assure its interests and long-term goals are satisfied, which also meet the interests of the applicants. Those interests obviously must include a reasonable economic return. The applicants are assuming the economic risks: the community is assuming the risks of long-term impacts (both positive posi-tive and negative). In other words, annexation annex-ation and development will occur only if the interests of all parties are reasonably satisfied. Whether this can be accomplished accom-plished is yet to be determined. I hope it can.
