The city council, without discussion, discus-sion, accepted the former chiefs resignation effective immediately. MR. MCILRATH submitted a six-page letter, with four pages of "attachments, to the council with a request that if the council did not accept his reasons (or explanations) for the allegations against him, then they should accept the let ter as a letter of resignation. Mayor Elmer W. Barlow said the letter had been reviewed re-viewed by the council and he called for a motion. Council-men Council-men Robert Linnell. Paul B. Allen and Jay R. Bingham voted to accept the letter as a letter of resignation. The other two council members were absent. ab-sent. AT THE same time, the council agreed to appoint Jerry K. Lemmon to the position of interim (acting) fire chief until a new chief is named. Mayor Barlow said applications applica-tions for the post of permanent fire chief will be accepted at city hall. FORBES said only that Chief Mcllrath denied categorically each of the allegations alle-gations against him and asked the council and city officials to accept his letter as a letter of denial of all charges and to reinstate him to the position of fire chief. MCILRATH was accused ac-cused by a firefighter of knowingly know-ingly authorizing overtime pay that was not done by some fire fighters. He told city officials that some of the money was misuesed by the chief to purchase purch-ase tires and other equipment for use on the chief's fire vehicle. Atty Forbes said that all information in-formation gathered from the investigation into the Mcllrath case has been turned over to the Davis County Attorney's Office for review. NO OFFICIAL criminal or civil charges have been filed against Mr. Mcllrath. The fire chief has not been available for comment during the past week. |
