Every manufacturer and every employer em-ployer of labor, except thoso engaged In agriculture, will bo directly affected af-fected by tho Workmon's Compensation Compensa-tion measuru which It Is proposed to make- a law In this state. Moreover, this law will flually affect In an Indirect In-direct way, at least, every person In Utah. Tho following arc-some of tho provisions pro-visions ot tho act: 1. An Industrial commission Is cro-ated, cro-ated, composed of throo members, who nro to recelvo a salary of $4000 per year each. Tho position of labor la-bor commissioner, state Btatlstlctian state inspector of coal and hydrocarbon hydro-carbon mines and board of labor, conciliation and arbitration are abolished abol-ished and tho functions heretofore performed by those officers devoivo upon tho Industrial commission. In addition tho commission Is charged with tho duty of enforcing tho lawi for tho protection of llfo, health, safety and welfare of omployes. Tho commission is also given Jurisdiction over safety devices, standards ot construction, con-struction, repair and mnlntonancc. 2. A stato Insuranco fund Is created creat-ed which is to bo administered by tho commission. Employora may Insuro In tho state fund or In stock or mutual mut-ual companies, authorized to do business busi-ness In this state, or If they can furnish furn-ish the commission satisfactory ovld-ence ovld-ence of their ability to do so, may carry their own Insurance 3. Tho law Is compulsory, employers employ-ers and employees automatically coroo under Its provisions. The schedule sched-ule ot compensation, la flxod at 65 per cent of the average weekly wages, to bo paid dating the period of disability disabili-ty arising out ot and In the course ot employment. Tho maximum weekly wages are $12,00 and tho minimum $7.00. Tho waiting period Is 10 days, during dur-ing which time no compensation need bo paid, but tho employer is to provide pro-vide medical, hospital and nursing services, but not to exceed $200.00. In thoevent of death $150.00 Is allowed al-lowed for funeral expenses. In caso of death, It the deceased leave no dependents tho employer Is to pay tho funeral expensos and $750 which shall bo placed In tho stato insuranco in-suranco fund. It thero aro dependents, depend-ents, they havo tho option ot accepting accept-ing tho compensation provided for in tho' act or of bringing suit against tho employor. Their acceptance of either bars thorn from tho right to participate In tho othor. In the case of total disability, considered con-sidered permanent, tho compensation Is to bo 55 per cont ot tho weekly wages for flvo years and 40 per cont of tho weekly wages for tho remainder remaind-er of natural life. 3. Aliens havo the samo rights under un-der the act as Americans, and alien dependents living In foreign lands, tho sumo compensation as American citizens. 4. All accidents of whatever na-turo na-turo aro to be reported to the Industrial In-dustrial commission within ono week after they occur. 5. In caso oithor party Is not satisfied satis-fied with tho decisions of tho commission, com-mission, provision Is made for an appeal ap-peal to tho dUtrlct court. 6. The sections which consolidate tho different departments go Into effect ef-fect upon approval, and the remainder remain-der of tho act on July 1. 1917. |
