Show A BIG MUDDLE Henry Diiiwocdej VTniits a Ee ccivcr Appointed to Take Cfearjje of the Palace Hotel 4 During the short time the Palace Hotel j has been in existence its management seems to have become involved in no end of financial trouble and suits and coun tersuits complaints and crosscom plaints are pouring in upon Justice Pyper and the Third District Court in a bewildering be-wildering profusion ILBrisacher owner of the property in addition to the action for 900 unpaid rent commenced a suit last month against O II Riggs Kate Shear Henry Dinwoodey and L B S Miller The complaint alleges that Mr Riggs and I Mrs Shear the proprietors of the hotel executed a certain promissory note payable pay-able to plaintiff for 2828 with interest at the rate of 1 per cent per month This note was secured by a chattel mortgage mort-gage on the furniture of the hotel The complaint alleges that defendants Miller and Dinwoodey have some claim upon the property which claim is subsequent and subject to plaintiffs lidh The plaintiff plain-tiff prays that the mortgage be foreclosed and that the claims of defendants Din woodey and Miller be barred Defendant Dinwoodey files a separate answer and cross complaint He also brings in a promissory note for 070 executed exe-cuted by Kate Shear and secured by chattel chat-tel mortgage on the same property included in-cluded in the Brisacher mortgage and alleges al-leges further that Kate Shear is now removing re-moving some of the property to a place unknown to him He also alleges that Kate Shear executed another promissary note for 300 secured by chattel mortgage I mort-gage on other property and that she is removing some of this property He I prays that the property be sold and that in the meantime a receiver be appointed I to take possession until the matter is settled set-tled P W Madsen has commenced a suit in Justice Pypers court for the foreclosure fore-closure of a mortgage on what property I prop-erty was not included in the Dinwoodey and Brisacher mortgages Madsens I mortgage was given to secure the payment pay-ment of 279 |
