Show THE HORRIS-MAMMOTH SUIT. Commencement of Some Interest-ingr Interest-ingr Mining litigation To-Day. The long-looked-for case of Elias Morris Mor-ris vs. the Mammoth Mining Company, was commenced in court this morning, with Williams, Young and Arthur Brown for plaintiff, and Bennett, Harkness & Kirkpatrick.' and Judge Sutherland, for the defense. This suit, -as the public are aware, is brought to determine whether the Mammoth Mining Company can be held liable for improvements constructed on the premises of the mine, supplies furnished and money loaned by Mr. Morris, while the gilt-edged fraud, Butler Johnson, manipulated the affairs of the Crismon-Mammoth mine at Tintic. Mr. Morris is the only one among the many large creditors whom Johnson left in the lurch who has refused to accept the compromise offered by the company. Nearly all of to-day's session was spent in impaneling a jury, and owing to the technical character of the case the utmost solicitude was manifested on both sides, lest some person either biased or otherwise other-wise incompetent should be allowed to slip in one of the juror's chairs. The work of obtaining the necessary twelve was completed about 2 :30 this afternoon, and just as they arose to be sworn it was discovered that one of the jurors had been excused from acting, and an open venire was immediately sent out returnable forthwith. Following are the eleven jurors already passed: Ephraim Hatch, Joseph Barker. John Wickel, Thomas Goodman, William Irvine, Gromway Parry, Ethan Petitt, George G. Hardy, O. D. Hendnekson, -Orson H. Worthington, Louis C. Shaw. |
