Show c 0 I no > A WICKED WHITE I His Girl Wife Keeps Hum and He Escapes the Polygamy Charge Elizabeth Ann Starkey Before the Grand Jury This Afternoon I Held On Two Charges of Contempt Will She Serve Them Out This morning at 10 oclock Charles L White held on a charge of unlawful cohabitation co-habitation anil polygamy and his alleged second wife Elizabeth Ann Starkey were brought in from the penitentiary and appeared ap-peared before Commissioner McKay The court room was well filled with subpoenaed I sub-poenaed witnesses including several of the Starkey family from Hooper not present during the previous days examination ex-amination JANE STARKEY I Testified in substance as follows I am mother of Elizabeth A Starkey and Mrs Wm Wayne I know the defendant met him at my daughters house in Salt Lake I saw Elizabeth at Charles Whites she was nursing Mrs White saw her before she went to Arizona dont know who she went with but she I came back alone Mr White and his wife visited us at Hooper and stayed several sev-eral davs Q Is Elizabeth Starkey married A I dont know that she is Q Is she married to this defendant A I do not know FRANCIS STARKEY The father of Lizzie said that Mrs Wayne and Elizabeth were his daughters Q Do you know the defendant Charles L White A Yes sir I know him Q Where did you get acquainted with himA A I visited his house to see my daughter daugh-ter Elizabeth who was employed there as nurse and brushmaker Q Is she married to Mr White A I dont know that she is married She was at our home on a visit eight weeks ago ELIZABETH STARKEY TIlE SILENT WITNESS Was called and asked whether or not she was married Imprisonment had not made her eloquent however and she was as mute as ever To another similar question she maintained the same determination deter-mination and declined to answer for fear of convicting defendant or perjuring herself her-self Not obtaining a sufficient amount of evidence to convict the defendant of polygamy and the allimportant witness refusing to answer questions the court I deemed it ADVISABLE TO DISMISS THE CASE And White was released from the charge of polygamy As he strolled leisurely up the street he seemed greatly relieved with but one charge and a 500 bond hanging over him while his alleged girl wife was escorted to the United States Marshals office to await the Grand Jury Lizzie Starkey is held on TWO CHARGES OF CONTEMPT OF COURT In the shielding of White from the punishment pun-ishment she is now undergoing The two fines amount > to 150 and some talk among lawyers as to the right to hold a prisoner for a fine of this kind is being made Commissioner McKay takes advantage of the same Territorial statute used by magistrates in such cases which provides pro-vides a days work or imprisonment for each dollar of the fine This being the case Miss Starkey would serve out 150 days to satisfy the fines The United States law permits a convict to take the poor debtors oath at the expiration of thirty days as was done a short time since by John Aird who was then re leased A DEMOCRAT reporter was permitted a SHORT INTERVIEW WITH MISS STARKEY During which she expressed herself as being perfectly satisfied with the course taken On being asked how she liked I prison quarters she replied that it was I the first Penitentiary she had ever seen and that it was a pleasure to get out of the old dungeon this morning She was confined in the room with Lizzie Deve reaux and baby and was TREATED VERY KINDLY BY THE OFFICERS Although she assumed an air betokening a tranquil mind it was evident that she was carrying a greater burden of trouble than a girl of her age is generally sub jected to |
