Show A New Pension Decision WASHINGTON September ISecond Comptroller Comp-troller Maynard has made a decision in the case of the claims of soldiers for arrears for pay and bounty who have been honorably discharged but who are charged up on the military records with desertion He says that in cases where soldiers have been marked on the roll and reported as deserters desert-ers and it appears that within a reasonable time thereafter and while the war was still in progress and the army engaged inactive in-active hostilities against the enemy he voluntarily vol-untarily returned to his company and regiment regi-ment and was unconditionally received into the service and was received on conditions which have been fulfilled not involving the forfeiture of pay or allowances and he subsequently sub-sequently rendered faithful and acceptable discharged military services and was honorably charged it will be held that the presumption that he was a deserter which the entry upon the military records and roll might create will be deemed to be conclusively rebutted and overthrown In such a case a soldier is to be treated as absent without leave The practice of the Second Comptrollers office discharged and allowances due in adjusting pay charged soldiers will hereafter conform to the above rules |
