Show I DOWN IN A COAL lINE I Cunninghams Suit For Damages Against thc Union Pacific The Supreme Court opened this morning morn-ing at 1 oclock pursuant to adjournment adjourn-ment After the reading and signing of the records of last session the case of Peter Cunningham plaintifl vs the Union Pacific Railway Company defendant de-fendant came up AAllliams Young appeared for the defense and Sheeks and Robinson act as attorneys for the plaintiff plain-tiff The case was set for a new trial last December and involves a suit brought against the company by Peter Cunningham Cunning-ham for injuries received In the transcript trans-cript it is alleged that on February 1st 1882 the plaintiff Cunningham was in the employ of the Union Pacific Company Com-pany as a coal miner in their Grass Creek mine located in Summit county and that to get to his work i was necessary neces-sary for him to pass through and along a gangway or dugout constructed before that time by defendant de-fendant for the purpose of working said mine It is also set forth that the company neglected to timber or secure the sides roof walls and pillars or supports sup-ports required I was a dangerous and unsafe mine of which the plaintiff was then ignorant I was in February 1882 that the plaintiff while passing through the mine or gangway to perform his work that coal and earth fell from the roof pillar support or wall upon him and crushed bruised and injured the plaintiff damaging his ankle and spine for which he asks damages in the sum of 25000 The complaint of negligence referred toby to-by plaintiff is denied by Williams Young Thirtyfour witnesses have testi fled in this case and the Court is now listening to the arguments |
