Show I AX IMPORTANT DECISION Judge Zane Decides that Utah Towns Have Power to Prohibit the Liquor Traffic A decision was rendered by Judge Zano this morning that is of vital interest to residents of all municipal corporations of this Territory as it settles the long mooted question as to whether under their charters cities and towns have the power to absolutely prohibit the traffic of intoxicating liquors The case was that of Tooele City vs Moses Bruneau The defendant was I prosecuted by the City of Tooele for selling i sell-ing liquor in violation of the prohibitory ordinance It was contended by the defendant de-fendant that the Legislature had no power to prohibit the sale of liquor or to authorize a city to do so The court held that it was competent for the Territorial Legislature to enact a statute directly prohibiting the sale of liquors or to confer such power upon any city within the Territory The Legislature Leg-islature had conferred such power upon Tooele City and the prohibitory ordinance ordi-nance of that city was therefore valid Judgment was therefore ordered against the defendants A large proportion of the cities of Utah have charters identical with that of Tooele and the effect of this decision is I such that all cities may prohibit traffic in I liquors ifthey elect to do so The case was argued by J L Rawlins for the plaintiff and Arthur Brown for I the defendant |
