uintah arid and wasatch counties being behig incorrect tor this talk is all foolishness until the question is raised in a legal manner calling into court the present bound bo ry roosevelt poosevelt is in duchesne county legally and 6 tio change its position will require mease measures res not likely to be taken up in an othor column we print a bom communication muni cation from the county attorney mr which throws some light on the legal pha phases s of the matter there is no lata iata that we have heard mentioned which even calls in ou question estion the boondry as now established except a map or two anyone knows that these maps are often wrong the map which is mosi relied on by Roosevel ts Vs opponents is the lan doffice map now this land office map should not be regarded as anything more than a map made from the wrong data because the lan doffice recognizes the uintah base and has published no information except the map showing that the official fic ial location locacio n of this base is not correct 14 the lan doffice had bad eriv information in formation contrary to the published data it would likely say so inan in an official manner As mettr matters rs reind the two counties concerned have established the line and this holda for ill 11 legal purposes until the state en engineer anys the line is wrong ard and e eon een en then as mr pays FRYS the old in ane for many good utah dear sir permit me to occupy some space in your valuable paper I 1 binte tl allt tt some controversy has P risen abent the location of nf the line between uintah and wasatch coun counties Vms any given locality I 1 wish t state that iiii ilmy my opinion tv alo question stion is ejot properly before the people the origin of the controversy is based on conflicting maps issued by the general land office placing the town veli in uintah county by careful ex aminat examina ton on of said map we fl and nd tent th t he ahe vintah special M merida 1 I a r iz s placed at ell rna matell n d degrees grecs 56 minutes west i tude instead of at derees 57 fi 30 as we have been ired ed it is located mr harmston in his article shows belond question that the meridian is 2 30 or 2 miles and 64 rods west from the special meridian to which mr clarke makes reply that the uin tali tah special meridian has not been accurately determined probably both are right but what effect will that have on the question guestion the uintah meridian was established by observations in the field in the year 1876 and surveys were made and pre surri suitable able patents have been issued for lands described as reckoned from brorn said meridian the objection is made that mr dubois could not abot establish the meridian with accuracy because he vas was away from telegraph communications that is not a good argument navigators have taking observations and working out their position as to latitude and longitude for several centuries and what the captain of a vessel can do daily it is only fair to presume that a chief of odthe the bureau of surveys can do for once with reasonable accuracy when uintah county leas kas created by act of the legislature on february 18 1880 they made the meridian the boundary A line that had no ex istance except in the minds of geographers they knew or are presumed to have known f the uintah special I 1 meridian and its location and all official maps made since that time show the U 8 M and the meridian as being 2 minutes and 30 seconds apart except the one rn mentioned above shortly after the opening of the uintah indian reservation the commissioners of wasatch pool halls which are prohibited county had mr 4 J F harmston at that time deputy county surveyor ve or of Wa wasatch county to survey the boundary which he did by calculating calculation i g the meridian from the uintah special meridian a as s established and at that time recognized by the general land office this line was accepted by uintah county as correct and has been the accepted boundary between the the two counties for about seven years and is conclusive upon the residence of ath counties and upon the courts of the state if at any future time a dispute shall arise between uintah county and its neighbor the question wil have to be settled by the state engineer according to the provisions of section compiled laws of utah 1907 but so long as the established line is satisfactory to uintah county I 1 know of no way it can be raised by wasatch h county or by any resident of wasatch county if when aen the lurth meridian is established assuming that at some future time that will be done it shall be ba found that its true course is is either east or west of the line as at present established it will still be within the province of the legislature to determine whether long established boundaries defining jurisdictions of courts and the ownership of property shall be arbitrarily swept aside or whether the di description of the respective counties shall be demanded to correspond with those actually established in any event that bridge is so far ahead there is no use crowing crosing it now when the general land office of the united states see fit to officially announce the longitude of the uintah special meridian based upon a later and more accurate will be time enough to adjust other lines established upon the theory that thatis it has been properly established very respectfully chas J quist |
