Show election contest behind three election contests in duchesne county charges of and fraud against the board of canvassers of that county iha abes complaints in which cases were filed last saturday on account of the tact fact that duchesne county la Is not yet organized gani zed the suits in contest are filed as pertaining to the business of wasatch county one contest is by C harry gray cray by his attorney ernest D macdougall of salt lake city mr gray ran for the office of county attorney against ray dillman who Is made mad 0 the defendant the complaint ol of mr gray which Is typical of the other two except in one particular alleges that the judges of election in certain districts made error in counting the votes tor for respective candidates the other contestants are jesse B peterson against S A russell tor for two year county commissioner and lars lara 3 marsing against again st elroy wilkins tor for sheriff all the plaintiffs were nominees on oil the socialist ticket grays complaint sets forth that he be believes that the judges of election in myton roosevelt boneta alexander and Stock more fraudulently permitted the envelopes containing their re lve tally sheets and returns return ato 1 0 be opened inspected and tampered with sufficiently to change the result of the election after they had been sealed up and directed to the county clerk cleric of wasatch county mr gray sets forth that the board ot of canvassers certified that dillman received a total of 1222 votes and that gray had 1110 votes voies to his credit the tact fact la Is charged mr gray that he was the socialist nominee and was indorsed endorsed indor sed by the democrats and asa consequence judging by the number of straight tickets deposited in the ballot boxes he be must have received not less than 1339 votes the plaintiff also alleges that the board of canvassers in violation of section of the compiled laws of utah of 1907 did not make the canvass in public and arild not permit witnesses on behalf of gray to watch the progress of the canvass mr gray asks that the returns be reviewed and canvassed by the court the that t the ballots be recounted that the election of ray dellman be set get aside and that gray be declared elected as county attorney of duchesne county recovering costs tor for his action the cases of the other contestants are identical with that of gray except that they do not allege endorsement by the democrats |
