Show NO CAUSE OF ACTION the case of alma R christeusen christensen vs IV D fitzgerald milton chavis james and ephraim chalk occupied the attention of the court all of last week judge joseph H erickson presided the case was tried before a jury composed of NL P peterson casten olsen and john wilson of richfield fred bohman of monroe ivan E bell of glenwood alberti albert J stevenson of central joseph shaw of vermilion and sidney E roberts of annabella the plaintiff was represented by willard hallsen hallsell of salt lake city and judge H N hayes of richfield and lewis larson of manti and 0 R michel sen sell appeared for the defendant the case grew out of a controversy between fitzgerald and christensen over some cattle and other personal property when mr fitzgerald came to Christen sens ranch near widtsoe to receive the property christensen refused to turn it over to him and according to the testimony of the witnesses for both sides christensen began to abuse the defendants during this period mrs christensen rushed out of the house and over to the stable where the men were she was apparently excited when she reached there but was quieted down somewhat by sir r C chavis ha is be before or anyone realized what was going to happen she said to chavis milt I 1 am going to faint and immediately fell into his arms unconscious and expired mr christensen brought action for damages charging that by the wilful wanton and unlawful conduct of these defendants they had caused a shock to mrs christensen from which shock she died the verdict of the jury was no cause or oc action |
