Show BIG SUIT as FILED AGAINST THE RESERVOIR CO BY irrigation PEOPLE 0 to determine water rights along the sevier river irrigating canal companies make alake piute diute con company pany and state defendants in suit while the deal between the newly organized pluto reservoir and irrigation company and the state land board bearing on oil the irrigation of lands under the plute reservoir is practically closed a litigation is pending as to the water rights along the sevier river the sevier river land and water company the delta land and water later company the des feret irrigation company the mell villo irrigation company and the marshall canals company have filed suit against the pluto irrigation and canal company and the state of utah praying for a decree establishing their rights to the waters of the river and enjoining the defendants fend ants amz from interfering the plaintiffs have for their attorneys tor J A melville judge C W morse and william story jr N J bates of richfield assisted by at torness who specialize in water rights will be counsel tor for the plate company and the attorney general will look after the interests of the state and the state land board the plaintiffs argument is that the sevier river is a natural stream the waters of which are subject to appropriation and use under laws of 0 i the state that on august ag 1902 he deseret irrigation company posted notice of intention to appropriate t 1500 cubic feet per second of the water of the sevier river to be used tor for irrigation and domestic purposes in the county of millard that by means of conveyances the plaintiffs are now the owners of all waters secured by the notice of appropriation that on may 10 1907 F r al lyman and one bagley filed application to appropriate second feet of the waters of the sevier that bhoj plaintiffs have become the owners of these water rights also and that the deseret irrigation company jil in the development of these rights has commenced the construction of a dam reservoir and canal system the plaintiffs will point out that they have expended more than 4 have brought under cultivation approximately acres of land and have more in course of preparation for cultivation the suit will not change the ac tivi ties of the pluto diute reservoir and irrigation company to any extent says mr air bates we are in possession wo we have the reservoir and we will go ahead irrigating the lands under our canals A final decision as to the water rights according to mr bates can be reached inside of one year oven even if appeals from the first decision should bo be taken to the higher and highest courts |
