Lindon City, 383 West Lakeview Road, Lindon, Lin-don, Utah 84602, 785-5043 785-5043 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: On or about Nov. 20, 1987, Lindon City will request the Utah Division of Community Development ("DCD") to release funds provided under Title I of the Housing and Community Development Develop-ment Act of 1974, as amended (PL 93-383) for the Sewer System Improvement Project to be installed west of I Geneva Road and east of Interstate 15 in Lindon City, Utah County, Utah. This I project is located in Census Tract 6. FINDING OF NO SIGNIFICANT IMPACT. IM-PACT. It has been determined deter-mined that such request for release of funds will not constitute con-stitute an action significantly affecting the quality of the human environment and accordingly Lindon has decided not to prepare an Environmental En-vironmental Impact Statement under the National Environmental En-vironmental Policy Act . of 1969 (PL 91-190). 1 The reason for such I decision not to prepare such Statement is that no significant ' t detrimental effect on the environment is anticipated. An environmental Review rvt:ord documenting review of all project activities in respect to impacts on the environment has been made by the I above-named city. This j Environmental Review Record is on file at the above address and is available for public examination and copying upon request between the hours of 10 a.m. and 5 p.m. No further environmental en-vironmental review of such project is proposed to be conducted con-ducted prior to the request for release of CDBG project funds. PUBLIC COMMENTS COM-MENTS ON FINDINGS. FIN-DINGS. All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the city to the office of the undersigned on or before Nov. 19, 1987. All such comments so received will be considered con-sidered and the city will not request release of funds or take any administrative action on the project prior to the date specified in the preceding sentence. RELEASE OF FUNDS. Lindon City will undertake the project described above with CDBG funds provided by the Utah Division of Community Development Develop-ment (DCD) under Title I of the Housing and Community Development Act of 1974, as amended. Lindon City is certifying cer-tifying .to DCD .. that. Lindon City, Kenneth D. McMillan as Mayor of Lindon City, and E. Ray Brown, as the City Administrator of Lindon City and as the certifying official approved by DCD, in their official capacities consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to en-vironmental en-vironmental rqyiews, decision making ana action; and that these responsiblities have been satisifed. The legal effect of the certification is that upon its approval, Lindon City may use the CDBG funds and DCD will have satisfied its responsibilities under the National Environmental Policy Act of 1969. OBJECTIONS TO STATE RELEASE OF FUNDS. DCD will accept an objection to its approval ap-proval only if it is on one of the following bases: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant ap-plicant approved by DCD or (b) that the applicant's environmental en-vironmental review record for the project indicates omission of a required decision, finding or step applicable ap-plicable to the project in the environmental review proecess. Objections Ob-jections must be prepared and submitted sub-mitted in accordance with the required procedures (24 CFR 58) and may be addressed ad-dressed to: CDBG Program, Division of Community Development, Develop-ment, 6233 State Office Building, Salt Lake City, Utah 84114. Objections to the .release.. ofrii. funds . on bases other than those stated above will not be considered by the Division of Community Development.
