Show An Ordinance AN ORDINANCE AMENDING THE PROVISIONS OF SECTION SEC-TION 6-1-43 OF THE PLEASANT GROVE CITY CODE; PROVIDING THAT IT SHALL BE UNLAWFUL FOR ANY PERSON TO ISSUE OR PASS A CHECK KNOWING THAT IT WILL NOT BE PAID BY THE DRAWEE; DECLARING AN EMERGENCY; PROVIDING AN EFFECTIVE EF-FECTIVE DATE; AND PROVIDING PENALTIES PENAL-TIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF PLEASANT GROVE CITY, UTAH COUNTY, STATE OF UTAH: Title 6, Chapter I, Section Sec-tion 43 of the Pleasant Grove City Code is hereby amended to read as follows: Section 43: ISSUING A BAD CHECK -PRESUMPTION: A. Any person who issues or passes a check for the payment of money, for the purpose of obtaining from any person, firm, partnership, partner-ship, or corporation, any money, property, or other thing of value or paying for any services, wages, salary, labor or rent, knowing it will not be paid by the drawee and payment is refused by the drawee, is guilty of issuing a bad check. B. For purposes of this ordinance, a person who issues a check for which payment is refused by the drawee is presumed to know the check would not be paid if he had no account ac-count with the drawee at the time of issue. C. An offense of issuing a bad check shall be punished as a misdemeanor. In the- nnininn rf thp Pleasant Grove City Council, it is necessary for the preservation of the peace, welfare, health and safety of the inhabitants of Pleasant Grove City, that this ordinance shall take effect immediately upon its passage and publication for the reason that an emergency exists in that enforcement of this ordinance is necessary to safeguard the health, safety and welfare of the inhabitants of Pleasant Grove City. Any person convicted of violating any of the provisions of this ordinance ordinan-ce may be punished by a fine not to exceed $299.00 or imprisonment for a term not to exceed six months or by both such fine and term of imprisonment. im-prisonment.
