AN OKDINANC K AN ORDINANCE ADOPTING THE UTAH TRAFFIC CODE RULES OF THE ROAD 197-- AS PREPARED. COMPILED AND PUBLISHED BY THE DEPARTMENT OF PUBLIC SAFETY OF THE STATE OF UTAH AS THE TRAFFIC CODE FOR THE CITY OF PLEASANT GROVE. BE IT ORDAINED by the City Council of the City of Pleasant Grove, Utah: SECTION 1. ADOPTION OF UTAH TRAFFIC CODE. The Utah Traffic Code - Rules of the Road 1974 - as compiled, prepared and published in code book form by the Department of Public Safety of the State of Utah, (hereinafter "Code) is hereby approved and adopted as the Traffic Code of this municipality, except as hereinafter specified, and is made a part of this Ordinance as though herein fully printed. (a) All references in the Code to the State Road Commission shall be deemed to mean this municipality and its depart-ment, agencies, or agents, unless the context otherwise requires. (b) All references to 'local authorities" shall be deemed to mean the governing body of this municipality. (c) All references in the Code to the "Department of Public Safety of the State of Utah" shall be deemed to mean the chief law enforcement officer of this municipality or his agent, unless the context otherwise requires. (d) All references in the Code to "Magistrate" shall mean the Justice of the Peace or Judge of this municipality, unless the context otherwise requires. (e) "Recorder" as used in this Ordinance shall mean the City Recorder of this municipality. SECTION 2. PRIMA FACIE SPEED - DESIGNATED STREETS. When appropriate street signs giving notice of speeds thereon are erected, the prima facie speed limits designated in Article 6 of the Utah Traffic Code - Rules of the Road 1974 shall apply to the appropriate streets, with the SKCTION i). FILING. Three copies (it the UUih Traffic Code - Utiles of the Koad 1974 hereby adopted by reference shall be filed for use and examination by the public in the office of the City Recorder. SKCTION 10. REPEAL OF (' O N F L I C TING O R D1NANCES. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 11. EFFECTIVE DATE. This Ordinance shall not take effect until the ex-piration of thirty days after its final passage and twenty days after its publication or posting. THROUGH ST R E ETS DKSI G N ATED. Those streets and parts of streets marked and signed as through streets are hereby declared to be through streets lor the purpose of this traffic code. SECTION 5. AUTHORITY TO ERECT STOP OR YIELD SIGNS AT THROUGH STREETS. Whenever any Ordinance of this municipality designates and describes a through street it shall be the duty of the chief law en-forcement officer to place and maintain a stop sign, or where safety and efficiency require, at any intersection a yield sign, on each and every street in-tersection of such through street unless traffic at any such intersection is controlled at all times by traffic control signals; provided; however, that at the intersection of two such through streets or at the in-tersection of a through street and a heavy traffic street not so designated stop signs shall be erected at the approaches of either of said streets as maybe determined by the chief law enforcement officer on the basis of an engineering and traffic study. SECTION (i. STOP IN-TERSECTIONS. The chief of police is hereby authorized to determine and designate in-tersections where particular hazard exists upon other than through streets and to deter-mine (a whether vehicles shall exception of Highway 91, otherwise known as State Street, for which the maximum prima facie speed limit shall be forty (40) miles per hour within the city limits of this municipality. SECTION 3. ANGLE PARKING. The chief of police shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets, but such angle parking shall not be in-dicated upon any federal aid or state highway within this city unless the State Road Com-mission has determined by resolution or order entered in its minutes that the roadway is of sufficient width to permit angle parking without in-terfering with the free movement of traffic. (a) Angle parking shall not be indicated or permitted at any place where passing traffic would thereby be caused or required to drive upon the left side of the street or upon any streetcar tracks. (b) Obedience to angle parking signs or markings: On those streets which have been signed or marked by the City Chief of Police for angle stop at one or more entrances to any such intersection, in which event he shall cause to be erected a stop sign at every such place where a stop is required, or (bl whether vehicles shall vield the right-of-wa-to vehicles on a different street at such intersection, in which event he shall cause to be erected a yield sign at every place where obedience thereto is required. SECTION 7. PENALTIES. Any person violating, causing or permitting violation of any provision of this ordinance shall be guilty of a misdemeanor. Notwithstand-ing other language or provisions in the Utah Traffic Code - Rules of the Road 1974 hereby adopted, any violator of this Ordinance, upon conviction shall be punished by a line of not more than $200, or by a jail sentence not to exceed six months, or by both such fine and jail sentence. SECTION 8. VALIDITY. If any part of this Ordinance is or shall be declared by a court of competent jurisdiction to be invalid such invalidity shall not invalidate the remainder of this Ordinance.
