Show TOUGH ON THE SHERIFF the action of a recent jury in ng la in a verdict against sheriff leigh tor for damage appeals to us as little less legs than an outrage against a public official the affat rises out ot of a little mistake toi foi which the sheriff was in no way responsible except that legally he be JE is responsible for the act of his de cuties in this particular case the deput ys mistake seem to be so BO awfully serious and yet un oer the jurys verdict the sheriff must pay a halt years year s salary as damages the essential facts facts ot of the case are briefly that while edward bentley was deputy sheriff he answered the telephone one day to hear someone sky say in substances this is J D hayes with the salt lake police department part ment arrest and hold W A johnson tor for us hes wanted tor for several things bentley went out onto the street and picked up john son boil who a as we get it was going no place in particular and had plent clenti of tome to get there he locked the latter up and then tried to locate hayes to report that ho he had his man but hayes be found ht hi held johnson over night and ariee the next morang to get in douel with hayes or the police department dep artmen and appealing by phone U V joseph B E richards in an attempt to get some word about the of the afternoon he received a win to release johnson error in order ing him held or words to that ef e feet johnson was immediately re leased and then he tiled filed suit to fo damages the case was tried by a local jury which found no cae tor for action johnson appealed to the supreme court the case was argued there and the court hold held with johnson sending it back to retrial re trial the next jury said damages the deputy probably erred in not confirming the telephone call and no boult johnson was somewhat inconvenienced and probably embar rasbel by a mistake which gasn wasn t an unnatural one but by no stretch of imagination can we conceive ot his big being damaged to the extent oi 01 or even yet the supreme court and the last jury have taken an attitude which Is io say the least discouraging to an officer whose deputy was endea endeavoring vering to be in the lis jarge 0 ills ilia duty damage against the man who called bentley would be fa more logical but it he bt be located then since there was itani it ani any actual damage the matte might prop property eFty have been dismissed lt it seems to us |
