Show Damage Claim Required by State A claim for damages filed with Park City officials by First Security Bank of Utah, N.A. was described today by a bank spokesman as being a necessary step under the provisions of Utah statutes. The action was taken on advice of counsel and in support of a claim made on behalf of the bank by Aetna Insurance Company. It was reported in a Salt Lake newspaper on November Novem-ber 30 that the bank had filed a claim for damages totaling total-ing $49,695.06 in connection with heavy damage incurred in the town's major fire last August 27. It was alleged that the fire did not start on the bank's property, but spread to it by reason of defective hydrants, water supplies and fire fighting equipment owned own-ed by the city. The bank spokesman said that the applicable section of the Utah code relating to claims for damages against a city or incorporated town stipulates that a claim must be presented within 90 days after the happening of such injury or damage to the Board of Commissioners or City Council. It further stipulates that no action shall be maintained maintain-ed against the city or town unless such claim was presented pre-sented as prescribed. The bank indicated that it was acting on instructions of its insurance company, but that its future concern in the matter was with the insurance insur-ance company rather than with Park City. It was also reported to The Record that to date five claims have been filed on behalf of tenants or owners of the damaged property.
