Show city council fails to 10 revoke n license the city council met in regular session last night and it was atter after one 0 c I 1 ock this morning when adjournment was taken tho the entire time with the exception of reading and approving tho the minutes of 0 the previous meeting being up in discussing whether or not to revoke the license of the now much agitated liberty pool hall and soft bott drink parlor the final result being a smiling victory for the forceful talking attorneys of mike Mel and tony floor proprietors of the place and a complete back down of the city council and signal failure of the city attorney against the persistent hamening hamerl ha mering ng attack of the attorneys tor for the defense only one councilman A H addy had the courage to oppose the all wise loquacious attorneys for the defense but he was alone while mayor macdonald opposed them and checked thera them occasionally as presiding officer he was helpless and with mr addy had bad to bear the chagrin of ark an ignominious defeat it was an interesting and sometimes instructive tive show with attorney roger mcdonough of our city and attorney P F W james of salt lake the star actors and the members of the city council as the comedians I 1 the story ot of liberty affair the following are the incidents of the liberty place to date on april 2nd and federal officers cooper and lund of salt lake with deputy sheriff dee workman and W R jefford raided the liberty place and found and confiscated a quantity of moonshine whiskey and a hundred or so bottles of beer the proprietors were arrested and each placed under to appear later for or trial on the ath on an affidavit from deputy sheriff dee workman to the effect that the liberty was a disreputable place mayor macdonald issued an order authorizing marshal baker to 0 close the place until the next meeting in of the council demanding the appearance pe arance of the proprietors to show cause why the license should not be revoked at that time then attorneys mcdonough and james were retained by the liberty and on their advice the place was opened on the lath marshal baker again arrested mr Mel and he be was placed under a bond to appear for trial for ignoring an order of the city council the attorneys for the liberty then secured a restraining order from the court preventing the mayor and city marshal from closing the place and a 00 damage suit was filed last saturday against those two officers then the meeting last night to determine as to the revocation of the license the Ale meeting eting mayor macdonald and all councilmen were present after the minutes of previous meeting were disposed of the liberty case was proceeded with the attorneys defendants and their friends soon filled the council chambers attorney mcdonough in behalf of the defendants made a plea to the council to abandon the hearing tor for a revocation but atter after considerable sparing by the attorneys the mayor decided to proceed with the hearing bearing sheriff joe dark clark deputy sheriff work I 1 man policeman brown marshal baker lohn john WIt wisther ther tony floor and mike mel were sworn the first five wit nesses testified as to the arrests con ot of liquors found on the premises the character of 0 the place that gambling was permitted disreputable women occupying rooms etc etc the defense offered no testimony the attorneys stating their case would be tried in the justices court and unnecessary and unjust to their clients to be tried twice attorney mcdonough made a spirited talk to tho the council maintaining that no evidence whatever had been produced that liquor had been sold in the sott sort dring and no reason given that the soft drink parlor license should bo be revoked that the liquor found was not i in the sott soft drink place buethe but the rooming house section and that there Is no ordinance empowering the council to revoke the rooming house license he then ripped into the testimony of wisther who testified he had gambled tor for money in the place had associated with with lewd women etc attorney james jamea then attacked the city ordinances going into detail as regards the various phases of the license laws and reciting what may happen it if the council persisted in revoking the liberty license and suggesting that instead 0 of running the risk of greater liabilities that the matter be compromised in a a friendly manner during the arguments ol of attorney james he said bald the raid made on his clients was because they had refused to pay protection money and the name ot of jefford was freely used in this connection he maintained other places much worse than the liberty were allowed to run without molestation because of protection and urged the council to operate cooperate co with him in bringing those who viere ere violating the law in respect and playing favorites be brought to justice and the mayor promised that operation cooperation co an executive session followed and attorney james and attorney mcdonough read law and talked law tor for an hour or more finally councilman addy said that it had been clearly demonstrated the liberty had bad been proved a disorderly house and moved that the license be revoked not a sound from any other councilman end and a second to the motion could not be secured then councilman chandler moved that the license be allowed to run rua until its expiration this was seconded by councilman mcginley McGl nley and carried chandler mcginley McGl nley and hoover voting aye and addy and lewis voting no and the meeting adjourned it was a one sided lawyers battle had city attorney johnson with his bis voluminous notes and law extracts had manifested one tenth the emergency ener gency in trying to convince the council that the license should be revoked as the liberty attorneys used in arguing against it the liberty would be closed today to day and in the opinion of the record none of the councilmen would have went to jau jail or suf ered any great monetary loss and it would have eventually lead to an adjustment of the present mixed state ot of affairs it is now up to the federal and county officers to do something |
