ANSWER TO A railroad company denies it owes the U C co tho defendant in tho case of tho utah construction company against the oregon short line railroad company has ailed riled an answer to the complaint in which it la asked that the action be dismissed as the defendant company dos not owe the plaintiff any further sums of money for work performed on the leavington leamington Lea cut oft for the following reasons it is stated the the companas comp anys resident engineer made an accurate estimate of the work done and the answer denies that he omitted any portion of the work either by mistake oversight fraud or otherwise and it is therefore dented that was entitled 10 receive the sym of instead of or leaving a balance payable to the plaintiff of the defendant it is alleged made to the plaintiff full and final payment including 10 per cent retained under tho terms of the contract until after completion of the work amounting to a total of 82 for which sum the plaintiff signed a release acknowledging payment in full and a discharge 0 all demands
