| Show EDEN irrigation CASE awill come up in district court next tuesday the second judicial district court fas opened today by judge booth and ll 11 defendants demerer demurer and plain taffs answer to the demur er were heard in the case of george A fuller D L calvin and virgil B trustees of the eden irrigation company vs allo sharp joseph coral and joseph Sevc defendants in which the plaintiffs pray tor i restraining order to prevent the da end ants who represent the claims of plain city from removing a j dam on the north fork of the ogden river and diverting the water from the eden canal the attorneys tor the plaintiffs asked that the temporary restraining order bo made permanent judge booth pointed out at length to show that as the complaint was at present filed any restraining order would be insufficient as only the three defendants mentioned in the complaint would be restrained and any other citizens might come up from plain city and remove the dam without breaking the letter of the injunction he showed that it would be advantageous to all parties to drop the case at present as there was enough water for both and that at present all parties are being injured the court adjourned until p in when the case was continued until 2 p m next tuesday and upon motion of C C richards of the counsel for the plaintiffs attorneys for the plaintiffs were granted until the first day of november 1904 in which to prepare and serve a draft of their proposed exception upon motion of C C richards in case of james thompson vs peter mcfarlane an old water case of several years standing thirty days additional was given to file a bill ot exceptions |
