| Show SWAN BOUND OVER MUST ANSWER TO TWO CHARGES OF FORGERY IN THE DISTRICT COURT bail is fixed at in each case being a reduction from first amount mike swan charged with forgery upon two complaints was arraigned in the municipal court tor preliminary examination in order to facilitate matters it was agreed by county attorney aniski and T D johnson attorney for the defendant that testimony should bo given upon both cases at the same time D A smyth testified that last saturday swan came into his saloon and presented a check for 1660 made payable to john dunn and signed utah construction company smyth asked him where he was working and the de fondant said he waa employed with the utah construction company in wyoming lie cashed the check and a short time after found out that there was something wrong with it james C jones of the utah construction company said that he signed checks tor the company and further said that during the past month his company had not deposited at all with the utah national bank william wright employed at the st louis beer hall said that swan tendered him a check tor payment of a glass of beer but he refused to cash the same as utah was spelled utha and look bona alde to him john murphy of the alm of murphy and garrett testified that be cashed a check of 1650 for swan who at that time was posing as john dunn the check being made payable to dunn and endorsed on the back with the same name oren hadlock testified that on the ath last he arrested swan he said that a blank check book with but a few checks torn out which had evidently been thrown away by swan was found by a newsboy who gave it to him detective fender stated that he had a conversation with the defendant in the office of chief of police the defendant stated that he had been work in gunder a certain section boas on the railroad fender asked him to write a letter to this section boss for a recommendation men dation he wrote a note the handwriting of which was identical with that on the checks acting chief of police brown said swan admitted that he made out the checks and wanted to know that it he would square up everything would he allow him to go no promises were held out to him if be should make any such admission the amounts he bad received from murphy and garrett and D A were given back to them by defendant the case was submitted without any testimony being offered by the defense mr johnson for the defendant asked for a reduction of the bond which request was granted the defendant being bound over to await the action of the district court and his bond reduced to on each complaint |
