had not been th at the question oje the cites sanitary condition came up in the council last night the session would have been a remarkably brief one but as it was the collection of garbage and carting it away caused a discussion which occupied at least one third of the time of the session the members were all present at roll call and the minutes of the two previous meetings were read and approved the recorder read the following communication muni cation from the mayor to the president and members of the city council gentlemen some time ago ono thomas ray a poor man and indigent sick person was found on the streets of ogden city the county commissioners of weber county refused to admit him to the poor hougg or to grant him any aid whatever ho therefore came to tho city jail where he has been cared for at the cites expense sir ray was over 70 years old and to have refused him a place to sleep would havo caused his death the man was unable to walk alone during the six weeks or more that he has been under the cites care in conversation with tho county commissioners they informed me that they are willing to have this case of thomas ray made a test case before the court and learn if t under the law the county is authorized zed to care for transient poor aa well as the poor who are residents of the county I 1 would therefore ask your honorable body to instruct the city at torney to bring an action in the court to test this case and settle forever the question of the liability of the city and county in caring for the transient poor the county officials do not deny the liability of alie county in caring for the poor who are residents of weber county I 1 respectfully ask your early action on this matter respectfully submitted upon motion of councilman shot seconded by councilman powers the recommendation embodied in tho communication was unanimously adopted the street committee to whom was referred the petition of G F Middlet and others for the opening of what is known as middleton road portion of twentieth street and tho communication of the mayor in regard thereto filed a report recommending the granting of the petition and that the communication muni cation of the mayor in regard thereto be filed accompanying the report was an estimate from the city engineer fixing the cost of opening the said street at councilman cross moved the report bo adopted seconded by councilman chambers and carried unanimously the street committee reported in relation to the mayors communication in regard to the opening of twentieth street and recommended the acting on the recommendation of the mayor and that the city attorney be instructed to prepare deeds for the right of way and have them signed report adopted unanimously the street committee reported in relation to the mayors communication in regard to the opening of wall avenue between twenty eighty and thirtieth streets recommending tho mayora suggestion be adopted and that alio city attorney be instructed to prepare deeds to right of way have them signed and recorded report waa unanimously adopted the sanitary committee reported that the kitchen at the pest bouso had been built the work having been done by the nurse and convalescent patients the committee purchasing the material and cooking utensils the entire cost of the kitchen and furnishings was councilman moved eliat the report be and that the accompanying compa nying bill be allowed and the auditor instructed to dradi a warrant for the same the motion carried unanimously the committee on tabea reported favorably on the communication ot ft acas asking for a quitclaim quit claim deed to certain property sold for delinquent sewage tax and recommended same bo granted the report WM unanimously adopted the sanitary inspector made the following weekly report of contagious dis cubba now existing scarlet fever 13 11 smallpox 4 total 28 A petition was received from david matson and nineteen others for an appropriation of 20 to be used in improving washington avenue from first street north to the city limits the pe stated this piece of is in bad condition and that in case the city appropriated this amount that choin du school trustees agreed to furi nish twelve hands and two teams 0 o aid in the work and to furnish dirt for grading while gravel could be obtained free by employing the man who furnished it with hl team councilman randall spoke in favor of the petition stating the city had an opportunity to pet worth of work done for one half that amount councilman williams stated he was in favor of the work but recommended the cutting down of the appropriation to and getting in work done ho put lna suggestion in form of a 1 motion after considerable discussion an amendment to thal motion was made by ahot that sufficient poll tax work be done to complete the work the amendment carried unanimously a did th amended motion A petition was read fram J M thorn BS of the ogden coffre co 2 twenty fourth street asking free permit to sell roasted coffee and other froni a wagon the petition informed the astonished the coffee wan manufactured from grain rala fd in this county the petition was referred to the license the municipal license then came up for consideration councilman actor readily of oraf introduced au alc plc ing a tax on billboards bill boards of five cents per lineal foot councilman nye had prepared one placing a tax of 50 per annum on all companies owning bill boards but accepted councilman which carried the ordinance then passed its first motion of councilman chambers seconded by councilman powers the rules were suspended the ordinance read by title and passed its second reading further action was then postponed for one week the poll tax ordinance came up for third reading councilman chambora Chamb cra moved to lay it over one week councilman hendershot moved to amend tho motion to postponing indefinitely seconded by councilman carr the amendment was accepted by councilman chambers as the original motion and carried councilman nye stated sir idellar who had been appointed as garbage collector had made a complaint that he could not collect from property owners for his work and that certain in the city were in a very unsanitary condition because of refuse and garbage thrown in the yards alleys and streets councilman powers called attention to the fact that for years the city has found it necessary to put one team on expressly for cleaning up alleys streets etc he favored going ahead and cleaning up yards where the owners refused to do BO and collecting by legal process attention was called to the fact that the weber canal is a continuous cesspool from to street and much severe criticism was indulged in by the council councilman hendershot at last introduced a motion that the weber canal from to street be declared a nuisance and that the incorporation owning it be instructed to fill it up within 30 days councilman powers objected to this stating the matter should be investigated before being acted upon to avoid damage suit councilman williams moved as an amendment that the matter be referred to the sanitary committee the amendment carried council men nye and powers favored putting on a team to collect garbage dead animals etc after some discussion councilman moved the sanitary committee be empowered to put a team on councilman powers seconded it councilman introduced a resolution that any hotel man restaurant man mci cht or other business man who set refuse outside either in the front or rear of their buildings and allowed it to remain bo guilty of a misdemeanor he was informed that on ordinance to that effect was at present on the ordinance book councilman cans motion then carried cross hendershot and williams voting no the council then adjourned until friday starch at 8 p m when they will meet to hear objections to alie paving of washington avenue |
