Show A W EXCITING BAY FOR hill he was rearrested re arrested again yesterday STAR CHAMBER proceedings sureties examined behind closed doors an unusual hlll once more free the liberty of oscar E hill was again jeopardized yesterday and for several hours it looked very indeed for the gentleman who has during the past week gained an extraordinary amount of notoriety none of which has for any good which he has done after a hearing before judge miner the matter was left in the same condition however it was on friday night and hill asat liberty under the old bond of early yesterday morning an affidavit was filed by five officers of the corneer acrel national bank in which they affirmed that it was their opinion that hill was about to leave the country and they asked that he be rearrested and taken before the court for the purpose of examining into the nature of the bond already given acting under tho request of the petitioners the audgo ordered that hill bo arraigned before the court and the arrest was mado by a deputy marshal in company bis wife and attorneys the cashier went bo fore the court and the was beet for hearing at the afternoon session of the court when the case was called the court room was crowded interested spectators and attorneys heated arguments were made maginnis and captain smith tho former took the position that the bond given before the commissioner having been drawn under the territorial statute would not hold good in any court outside of the territory should any of the bondsmen be found in any other state or territory in case of the forfeiture of the bond he also held that the amount of the bond was not sufficient to hold the defendant considering the serious nature of the charged and in addition found some fault with the sureties who had attached their names document captain smith took the ground eliat no evidence had been put in at the preliminary hearing which showed that the defendant had over taken ono cent of the banks funds and that could in no consideration lie more than one of the charges tried the prosecution would have to elect upon which count it should stand provided there was more than one count returned from the grand jury the bond was too ghigli already be said and the sureties suri ties were of the best in the country during the course of the arguments authorities almost without number were cited by the attorneys in support of their position hill was evidently much affected by the accusations which hurled at him by the district attorney just before 4 the arguments areu ments were finished and the case gentta the court for a decision judge miner held that to interfere aino of the benl bo nl the commissioner but decided to examine into the financial standing of the various bondsmen after a short recess the case was again called keally all of the bondsmen were on hand and judge miner ordered the to call them in their order before proceeding with the hearing captain smith stated to the court that the bondsmen did not desire the public to become familiar with their private business affairs and had requested that the court room be cleared during the examination of all but those interested in the case the court officers and attorney of the bar in accordance with the request of tho exceedingly modest and evidently somewhat frightened bondsmen the court room was ordered cleared and the case proceeded behind closed doors the star chamber proceedings did not consume much time however as judge maginnis decided to stand upon tho bond as it came from the commissioner rather than to jeopardize it by what he considered illegal proceedings tho attorney held that the court did not have the examine into the financial standing of the bondsmen who had already been examined and accepted by tho commissioner but it did have the authority to increase the amount of the bond provided it was shown that that already given was not strong enough or of sufficient amount to hold the defendant the defendant made a proposition to increase the bind 1000 thomas G burt pledging himself for the amount but the prosecution bield to its former position and the proceedings were ordered dismissed by consent dortho second time hill was a free man and will undoubtedly be allowed to remain in that condition until the the grand jury |
