zane and the prosecuting officers cerR of the court that him and that on the of october 1885 affiant WAS married to said hannah powell by judae zane the same brine the date of his release and the said hannah powell being the same woman named in the complaint against him for polygamy on which he was tried and convicted that on or about the ath day of november 1885 affiant was accosted by one moore at the time a guard at the in the employ of marshal ireland who asked him if he was at work and on being advised in the negative said you damn fool why dont you go and give some of these damned poloy mentioned endeavored to persuade affiant to go with him to the marshals office to arrange about the matter and affiant avers that the food at the penitentiary during his sojourn there was in many respects unwholesome that the meat was frequently sent out from the trouble as it could not be eaten and the meal biad to be made on dry bread and coffee that the was also bad and could not be each on tent iary that night and nest morn ing when tho prisoners were called into breakfast and ave guard had re cirod and bolted door sarno of the prisoners seized affiant and held his arm behind him while they placed a rope around his neck and hung him up to the joist of tho room till his sight left him and be was getting black in the faccas some told him after ho was let down he applied to the warden for something to relieve hia throat as he was so much hurt that ha could not swallow and ho was also shaken in his nervous so cioch that he was laid up for two days and all the medicine that was furnished him of any kind waa three rn orphine pills which ha did not tako that bad treatment had been usual for bome lima by the prisoners before affiant went there and it wa not until the affiant complained and tha desperate character of his case forced li selfon the at marshal that it was stopped by his order men before that had been tossed in blankets and compelled to fight with other prisoners to escape lie terrors of initials ini ion as it was called no attention had boen paid to anything of the before although it was well knowli affiant had himself warned the guard that waa intended on him but the guard while promising pro to protect him retired as above stated and a prisoner bolted alie door on the inside and athla left the prisoners to do aa hey pleased above described
