Show KENNEDY AND EBERHARDT m FREE Following the testimony of T. B. Nlshlmura, In the preliminary hearing I of James Eberhardt and Ralph Ken nedy, charged with murder, yesterday yester-day afternoon, other Japanese witnesses wit-nesses corroborated the story told by him as to the tragedy, but none could swear positively that the defendants were the murderers. Joshua Mlddleton and H. Shurtllff. who. were held up by the desperadoes despera-does immediately after the murder at the MiFPlon House, were called to the witness stand, Mr. Mlddleton stating that Kennedy looked much like the man who held a gun In his face that nlcht. but he would not state positively that he Is the man. Shurtllff stated that, In his opinion. Kennedy and Eberhardt are not the men who robbed him and Mlddleton the night of the murder. Ho said he could see no resemblance between the defendants and the murderers. The hearing was resumed this afternoon af-ternoon at 2:30 and Helen Stone, Norma Nor-ma Russell and Mrs. Martha Burnett j testified that, at the time of the al-I al-I leged murder, Eberhardt and Kennedy I were In their company, nnd could not have possibly been at the Mission house. The murder was committed at about 15 minutes to 11 o'clock and the witnesses wit-nesses for the defense state-d that , the boys were with them from 10-30 until after 11 o'clock. The decision of the court was that the Identification : tae defendants as the murderers had not been proved prov-ed and that they should be discharged. discharg-ed. The young men were given their freedom. There are no other clues nt this time as to the guilty parties. |
