If the farmers of Salt Lake county carry out their Intention Inten-tion to cite the American SmelUng Refining company into court for contempt. It Is charged that tho (melting company has rgnorcd the decree rendered In the test case of James Godfrey against the smelter. In which tho company was ordered to remedy the smoke nuisance. The farmers say they hare reached a point where patience has ceased to be a virtue, vir-tue, and the case Is once more to be taken Into the courts, unless the smelter company changes Its treatment treat-ment of fumes. At the meeting of the general committee, com-mittee, ot which John C. Mackay is chairman, during the week. In response re-sponse to request, the enh-commHtee. made of O. P. Miller of Fourteenth South aud State 6troets. Dr. W. C. Ebaugh of the state university , and A. E. Leo of Murray, made another report on 1U Inspection of the smelter, it being shown , to the satisfaction 'tr the i general commiUee that only . la one Instance, during June of last year bad tho court order been followed out by tho smeltor company. The Sub-comrolttee presented a written writ-ten report on Its inspectiona up to October, 190!,. and made a verbal report re-port of visits tlnco that time, showing a total ot fourteen visits to the smelter smelt-er in all. Report After Making Visits. It was reported by tbo committee that, with the exception of last June, the smelter allowed tho smoke from its roasters to pass directly Into tho stack; Instead of through on 1,800-font Monlcr flue and settling chamber, ns demanded in the court decree. Out of seventeen visits to the plant, the committee reported they nad round this condition to exist, and it was reported re-ported to the general committee that tho smelter company, with the one exception, had utterly failed to comply com-ply with the order. So great have the protests from farmers becomo that the matter was referred to Attorney Joseph L. Rawlins, Raw-lins, with Instructions to write the American Smelting & Refining company com-pany that they have failed to comply com-ply with the court order, and that It would now be necessary to clto them Into court for contempt. The smelter smoke causes have been attracting more or less public attention for a number of years.
