The offer of the county attorney was contained in a letter to George ' F. Short, state attorney general, who has been Instructed by Governor Robertson Rob-ertson to Investigate the conduct of County Attorney Hepburn and District Judge Mark L. Bozarth In connection I with an alleged embezzlement by i Earnest L. Bozarth, brother of the district judge. The alleged felony, according to tho go -ernor's petition, v. as uio em ruled with the assistance ot Judge llozarth and County Attorney Hepburn, who, the governor's petition alleged allowed the former commissioner to go without with-out prosecution after permitting him to pay back some of the money. The governor's motion for a change of Judge was overruled by Judge Bozarth. Bo-zarth.
