Show A HORSE gaorge F seagers secures the rights on his black Gel dlag the supreme court yetter yesterday dayl affirmed the judgment of the first district court here in the case of hill and margary against george F seagers sealers ransford Rans lord smith esq being attorney for plaintiffs and williams rennick attorneys for defendant this was a suit of claim and delivery brought by Aless rs hill and margary at alleging that they were joint boint owners with said defendant in a certain black gelding and that defendant bad possession os session and refused on demand mann to deliver the horse to them or to allow them to participate in the use odthe of the horse the defendants counsel williams rennick demurred to the complaint because it did not state facts sufficient to constitute a cause of action in that one co owner of a chattel could not bring this kind olfaction of action against another co owner which demurrer the district court sustained dismissed the complaint and adjudged a return of the property to the defendant and gave jud judgment ment for costs the e plaintiffs 1 by their attorney capt smith appealed to the supreme court which as before stated unanimously affirmed the judgment with costs this is the second horse case from this district which haar hag been affirmed by the supreme court stock men wen will find the law relating to horses pretty well defined in our territory the horse has been i a prominent remittent tent factor in the litigation of our parent great britain for several centuries the horse in i in fact is a favorite animal among all the english speaking families odthe of the earth hence it ia is a property well known to the courts |
