tile execution of Il michael ichael mooney at malad last friday we rupp supplement lement tile brief telegraphic report in our last issue with the following account by our special correspondent E artor HERALD michael mooney and F frank rank barnea barnes on the ath day of october 1881 went into the utah northern railway station at F franklin in idaho about 10 OCl OCIC in itt the evening with the avowed purpose of robbin robbing g tho the safe in charge of the office agent and telegraph operator joel hinckley in the attempt at ut robbery hinckley was SHOT AND KILLED FILLED by cither either mooney or barnes and from all the evidence adduced on the trial mooney was wa ta the ie man mail who fired the fatal shot on the tile 3rd ard day of november ci iiii ht days afterward afterwards barnes barnos and mooney were captured by sheriff wm brown of ogden y and other others near fiarn barnes c confessed to his complicity in tho the murderous transaction and te testified stifled that mooned was the man who shot hinckley Hinc krey this mooney denied in his evidence ia in the tr trial y but a preponderance of the evidence bein being against his version the jury fauna found him GUILTY or in tho the first degree and he lie was zai sentenced to be hung on the day lay of january 1862 barnes was sent to the territorial prison for 15 years there thre is a marked diffie difference rence in the characteristics of tho the two men barnes being cowardly and a man easily persuaded and led by one of astron a stronger germind mind and mien mooney aas has a plentiful supply of just what is ia needed in a des desperado rado pluck and aud no religious Ecru scruples pITI to overcome to deter him in the execution ol 01 of any any diabolical deed once conceived however dee desperate its character he found a willing tool toot in barnes I and suspicion exists that others bo side mooney looney and barnea barnes were knowing to the scheme of contemplated robbery if not implicated in the murder so far however every effort to obtain any furt further lier revea revelations in regard to the matter from either mooney or barnes has failed after cirit sentence to ban hang his attorney 11 M bennett took the ho caso case on appeal to the supreme court of the territory in a lill bill of exception exceptions as to certain errors of the district court on the trial A ag x the supreme court did not meet mt till last september mooneye LIM WAS to await the of the decision of the tile highest tribu naLof the territory when the case camo came up the supreme court with a full bench sustained the action of the lower court and mooney was again brought into court at malad city atthe at the november term 1882 and the lion hon john T morgan fixed the time of his execution for the ath day of december 1882 when mooney kras wa brou brought lit into burt court for thu pur poe he sid did not flinch a muscle quaver in the ind or evidence any interest or symptom beyond a studied odd cold indifference to t the scene feene and there w ewt a spectator present buteas but was korep arsted apparently parent vently ly than the prisoner ioner toner HAD IN JAIL over a year without being out of hia his cell was pale and a recent spell of sickness had bad cut him down in flesh li but there was mooney anthe eye the man or demon was there and hia his glance at the court and spectators if it signified anything was a haughty coliten t and bothin nothing about the man or via hia actions could bo be construed into any desire or expectation of sympathy y or derev mercy he ile seemed to rea ize ba at hia his efi chances ances of help from his fellow man was eh exhausted austed and he lie seemed stolidly indifferent as to hims himself elfand and the affairs of men no doubt ho he enjoyed a quiet thought of a possible chance at escape from jail and this is corroborated by the fact that on oil three different occasions on the examination of ins ills SHACKLES CKLES they were found sawed once entirely in in two and twice nearly so this was done the first time by weeks of labor with a piece apiece of glass obtained from a broken window in in hia his cell and tho the other times with several pieces aftin of tin and hoop boop iron lm improvised provid into miniature saws after the fixing of the day far for hia his execution dec fth tho the sheriff of gave orders for a death watch tobe to bo put in vis his cell and thus cut off any po wilile escape that might be contemplated by the prisoner about the middle of Wn aniber iber dr J IV morgan or a n and rind others of malad who are opposed to capital punishment or principle ciple got up and circulated r ted a petition and sent the same lame to governor J B neil askin asking that the deal death h sentence Bente of lichaa michael mooney be e changed to that of imprisonment FOP FOR L LIFE I fr on tho the reception of this a reprieve was sent dawn down and the sheriff ordered to delay the execution until the tile day of december 1882 in order that the governor time to inquire into the facts and circumstances connected with the case and also give time for a further expresion of the people matters now began to look favorable again for mooney and he lie wa was of course aware of the eff lorts being mad made in lw behalf and hope once more cheered the doomed man fora chance yet remained A long time had elapsed since the murder bublic PEELING FEELING was quiet and when once tho the laws aws delay begins tho the chances aro am gan generally favorable for the accused the tha partner of lib his guilt gull t barnes was incarcerated car in a prison for 15 ye year arho io was equally guilty of murder why y should mooney be hung justice ou ought b t to be satisfied wi with th a lifes I imprisonment rn such was the reasoning and such was the sentiment sought to be worked up amongst the people generally and thus insure a commutation but lut joel ciuck icy ley had friends and they remain bared his many manly and sterling qualities his ills youna young life lite had been stricken down without a moments warning A dastardly and coward ly murder had bad been committed the citizens life and property was nt at the mercy of any and every renegade tramp JUSTICE MUST BE DONE th the e I law aw m magnified rill fled and murderers ere erg must hang bang lu such qi were the views on tho the other aide counter petitions were sent to the governor and cadi each side represented before his ills excellency for and against tho tile execution I understood also that the governor requested the hon judge morgan and district attorney willard crawford to give him tho the benefit of their viam or the nature of tho tile evidence against mooney and whether it warranted tho the verdict of tho jury from all I have been able to learn the governor has acted throughout in a spirit of fairness fair and ind while willing to award the condemned man tho the benefit of all rill doubts is still desirous dee irous that tho the dignity ot othe the law and demands ofa of justice us should alo alao be as strictly guarded UT dec came and the sheriff had received no tidings from the governor c if none came erme before two next day mooney by that time must bo be dead under the re spite of ilia excellency tho the scaffold was constructed and finished on thursday ev evening enin b by y the carpenters tat at work I on the io new court houe and the coffin coff iii was also made no perceptible chan change e wa was s found in the tile feelings or demeanor of the condemned man vian on thursday unless it was an in increase of F for or coma some re reason aon not warranted by treatment ho lie contracted a violent hatred against the sh sheriff erill and breque frequently antly vented out his ills spleen against i ann during the day ono one of the prisoners prison cre in the jail had intimated his willingness TO CUT THE ROPE norn at itt the execution and when asked by the sheriff if he would boso doso that mr homer has hu dono done all re he could consistent with the faithful discharge of ira Ws duty to make the allotted time of mooneye Moo life as comfortable for fur table as pos possible dible several gentlemen waited upon balopue mooney in his cell on thursday and offered him tho the servious servi oes of a clergyman if he lie wished any religious consolation but he lie declined the tile proffered services thursday was pasted by the condemned man in a comfortable manner talking good humo with hia his guards and c expressing Kp a regret that he be did KOT NOT KILL his companion in in guilt before their capture in reply to questions mi fl to whether he wished to say anything thin in the public prints he be said emphatically be lie did not wish to say ay or have anything said ia im regard to him whatever he refused to give his age place of birth or any fact whatever of a historical nature no one believes hia his real name to be Moone mooney yand and unless he be makes a confession within the next two hours all that will ever be known concern concerning liis his history is what is known since hia his aart arrest L THE TUE JAIL is a log house about feet and the scaffold ild is erected immediately in front of tai the jail which is tho the west end the jail ail is enclosed with a i board fence about 15 feet high the laws of the Terri territory torT requiring an execution to be in private elwe the sen scaffold frold is a substantial piece of framo work the lower part from the trap being boxed around with boards so the body drops out of sight of the spectators within the yard the trap is a double door with binges and sprung by means of a cord run by pulleys from underneath the cord being conducted within the jail where the party springing the earns same L is out of sight and unknown about 11 am the shackles were removed from mooney and he underwent a thorough wash and put on clean clothes no apparent signs of weakening is noticeable 1130 the barber came and shaved mooney who sat in the front room of the jail directly FACING THE SCAFFOLD sc and during the time of being shaved looked constantly and steadily at it he ile is rather a good lookin looking man about thirty years tears of of age ang and is dressed in a black anew eu it white shirt and neat black slippers his ills looks show that the inner man ia is heavily worked and strained sub ab itself to the powerful ordeal to come and the paraphernalia of death Eur surrounding rounding him must have its solemn effect his scaffold frold faces facts him the rope dangles under the beam lib his coffin is placed open on a board just to the left of where he talk falls what must be the feelings of a man thus viewing in full health all the arrangements for hia his DEATH AND indifferent manner during the peru perusal sal of these solemn documents time was then called by the sheriff and mooney asse ended the scaffold a little wavering at the start but he stepped upon the efforts at sit breath aud and in ten minutes minu besl mooney loon ey was ival pronounced DEAD by the attending physician dr drake his body was immediately nedi lowered into his coffin and conveyed
