Show from saturdays daily aag THIRD DISTRICT COURT the case of john reeves TS J L gillogly this morning judge emerson overruled the demurrer of defendant to the complaint holding that the publication set out was a libel per se and that such being the case there was no necessity to aver special damages also holding that the libel was against the defendant individually and not against him as a railroad official therefore the judge sustained the motion to strike out the second and fourth counts of the complaint the tire parties took exceptions to these rulings and sixty days were granted the defendant to answer first and third counts of the complaint which are for the publication of said libel to private persons and then for publishing the same through the columns of the daily dispatch tho case it is expected will go to the jury at the november term of court and will be an interesting trial |
