Show Charges That His Brother, Willard S. Cragun, Unduly Influenced Mother Charging that his brother, AVillard S. Cragun, and his. wife, Henrietta 1 Cragun, exercised undue influence and control over his mother at the time of her death and insisted upon her executing her will In their favor and giving them possession of an estate of approximately $8000, Calvin Crn-gun, Crn-gun, son of the late Laura Cragun, filed contest to the alleged will In the district court this morning. In his contest Calvin Cragun set forth that his mothor died In Pleasant Plea-sant View, April 21, 1920 and left nn estate of real and personal property i of the approximate valuo of 3000 and j an interest in the estate of her do- I coasod husband amounting to $5000". j He further alleges that his mother; left seven children, and was not of j sound mind when she executed her will, and that the will was procured; by undue Influence of his brother, j Willard and his brother's wife. It is also allaged by Calvin Cragun ! that for some weeks prior to her death, his mother was afflicted with disease of the mind and body and at times was unable to talk or to knowingly understand under-stand the ordinary affalrr, of life or to transact business. His mother, he alleges, died twenty-four twenty-four hours after the execution of the will, and for several days before her death she was unconscious and utterly Incapable of understanding any thing, and that when she was In such condition, condi-tion, Willard Cragun 'and his wife were in attendance upon her and insisted in-sisted upon her executing the will, beseeching be-seeching her to do .0 by solicitations, his mother not knowing what effect the will would have on the disposition of her property. 1 At the actual lime of tho making of tho paper, Calvin Cragun alleges that his brother and his wife exercised exercis-ed a controlling Influence over the i mind of his mother and wero thereby able and did direct and dictate to her what she should do In matters relating re-lating to her property. Calvin Cragun prays the court that the will submitted by his brother be denied probate and another will presented, pre-sented, be probated and he bo appointed appoint-ed executor of the estate |
