Show U 1 i HI A u J IN POLK ACTION AGAINST MRS EMMA WERTZ IS DISMISSED city attorney failed to see any good grounds for the suit robert major withdraws charges police court was full of surprises this morning one case was dismissed because the witnesses did not report on time tho plaintiff in another asked that it be dropped and the defendant in a third asked permission to employ a lawyer and retaliate by filing a charge against tie complainant in the first case mrs emma wertz was charged with vagrancy on corn plaint of G T terry tho complaint was the result of a quarrel over the house at 2419 quint avenue terry has a civil action bonding against mrs wertz to gain control of the premises it Is alleged that he took of the house monday night sat on tho stairway until 2 a m and refused to permit lodgers to take their rooms until they had pad him the rent mrs wertz objected and struck him in the face with a broom stick then he charged her with vagrancy when the clerk read out the names of the defendant and called for the witnesses the latter failed to appear on recommendation 0 the city attorney who stated that he did not think ano case as meritorious as he at first thought judge murphy ordered it dismissed scarcely had he finished speaking when in walked terry with two witnesses the case however was not heard and mrs wad freed from the charge after ijas attorney had asked for a continuance robert major plaintiff in the assault and battery charge preferred monday against his brother jack major went to judge murphy interrupted the proceedings and asked that his brother be not prosecuted his honor referred him to the city attorney young major alleged that the older major spanked him with a coal shovel the mother of the boys a widow failed to appear on account of sickness it Is claimed that an attempt was made to have the younger major pay 5 as the costs of court but his attorney served notice would be trouble from some ono it such were done because M plaintiff had a lawyer D chapler Cl apler defendant in a disturbing tur bing the peace action asked for a postponement so that he too could employ advice As soon however as an extension was granted he to a complaint charging with assault with a deadly weapon |
